The three-year pandemic has dealt a heavy blow to the development of the real economy.At the same time,with the development of smart hardware equipment technology and the innovation of the mobile internet,the online economy,represented by the direct broadcast e-commerce,has developed rapidly.Due to the diversity of live broadcast platform,rich live broadcast content,new form of communication,easy to watch,price concessions and other characteristics and advantages,live tape has been widely welcomed by consumers.But behind the boom there are also many thorny issues that make it difficult for the authorities to monitor and enforce the law.Such as live with goods in the process of false propaganda,false advertising and with deceptive,misleading commercial publicity and other illegal acts frequent.Given that it is difficult for consumers to obtain evidence while watching live broadcasts and they do not know who is responsible,which makes it difficult for consumers to lodge complaints and defend their rights,and that the regulatory and law enforcement systems can not completely deal with the novel forms of illegal acts committed by live broadcast e-commerce,although there are many relevant laws and regulations,it is not clear how to apply them,so that the effect of law enforcement supervision is not obvious.Therefore,the problem of application of law needs to be solved urgently.In order to effectively regulate the act of carrying goods for live broadcast,this paper clarifies the legal status and legal relationship of each subject in the process of carrying goods for live broadcast from the perspective of law application,and determines the scheme of law application,according to the case analysis to put forward the problem,analyze the problem,solve the problem of research ideas on the law application of live broadcast with goods in-depth discussion.First of all,this paper analyzes the manifestation of the illegal act of carrying goods through the cases of the law against unfair competition,the law of advertisement and the law of protecting the rights and interests of consumers.Secondly,aiming at the problems of the false commercial propaganda in the live broadcast tape,as well as the difficulties in the application of the law caused by the ambiguous nature of the false propaganda and the false advertisement,there are also difficult to protect the rights of consumers,supervision and law enforcement difficulties,and other issues discussed and demonstrated in depth.Finally,an effective solution to the above-mentioned problems is proposed.One is to improve the Unfair competition law to make up for misconceptions and civil liability.The second is to perfect the advertising law and to build the anti-unfair competition law and the advertising law-based legal application system,to solve the problem of false advertising and false publicity qualitative ambiguity.Third,consummates the consumer rights and interests protection law to solve the consumer safeguard right difficult question.Fourth,the construction of a comprehensive law enforcement and case treatment of the law applicable system to solve the practical problems of law enforcement and supervision of law application.
