As a new online product marketing model,product live streaming is widely popular among consumers,and the rapid growth related to it has greatly changed the way society consumes in recent years.However,convenience and discounts are accompanied by multiple infringements on the legitimate rights and interests of consumers.Issues such as false advertising,unclear liability for infringement,and difficulties in consumer protection.D.The law should be an important method of social management,responding to direct sales in a timely manner.However,due to the lag of the law,it is difficult to protect consumer rights and interests in the face of some new types of illegal live streaming activities due to the lack of relevant regulations.To study the issue of infringement of live streaming frequency bands,separate the legal issues behind them,and propose targeted solutions to promote the orderly development of the live streaming industry.Therefore,in addition to the first part of this document(introducing reference knowledge related to on-site delivery),the following four aspects are mainly discussed.The first part provides an overview of the live streaming frequency band.Firstly,by further analyzing the legal relationships between live streaming participants and different participants,we understand the reasons for the ambiguity of the main responsibility qualifications,and explain the concepts and current development status related to live streaming.The complex trade relations and other issues provide a theoretical basis for targeted implementation of corrective measures in the future.The second part outlines the main manifestations of live streaming infringing on consumer rights.The specific manifestations of infringement on the legitimate rights and interests of consumers,such as the right to know,the right to claim compensation,the right to safety,and the right to safety,illustrate the problems in consumer rights protection and highlight the necessity of protecting consumers’ rights and interests in real-time products,Propose specific practical cases and reflect the issues in the form of cases.The third part analyzes the practical dilemma of consumer rights in real-time goods from different perspectives.Firstly,he pointed out that at the legislative level,the responsibilities of entities in terms of legal provisions and disclosure systems are not clear.Secondly,there are issues with inadequate supervision and lax law enforcement discipline in the process of law enforcement by administrative agencies.Finally,there are difficulties in consumer protection and unreasonable allocation of burden of proof in the judicial system.The fourth part proposes solutions to consumer protection issues.Starting from the issues raised in the third part,corresponding improvement methods have been proposed.That is to say,in terms of legal system,it is necessary to improve the legal system and information disclosure system of live streaming products,and clarify the subject of infringement liability.In the field of law enforcement,administrative departments should develop new regulatory forms and flexible law enforcement models.The court should broaden the channels for consumer protection and improve the evidence system.
