| Stability has always been the top priority of Tibet’s task and the key to build a safe and harmonious Tibet.In recent years,with the rapid development of society and economy in Tibet,people’s production,life styles and values have undergone major changes,as well as social conflicts and disputes which are ranging from destroying survival order to affecting social stability and even national security in grass-roots society have become prominent.As a major force for stability,the public security organs play an important role in resolving disputes,promoting social harmony and maintaining social stability.Disputes Mediation has become the daily business in the police station.However,due to factors such as vague laws and regulations,insufficient mediation capabilities of the police and an unspecified linkage mechanism,it found that there were problems in the practice of dispute mediation,such as different intervention limits,single mediating paths and poor inter-departmental collaboration.It has affected the function of dispute mediation by the police station.Therefore,how to mediate disputes by the law and regulations has become a problem that need to be solved urgently in police station.This article takes the grass-roots dispute mediation by urban police station in Lhasa as the research object,aiming to explore the status quo and problems existing in the process of grass-roots dispute mediation and try to put forward targeted suggestions based on mediation practice.In addition to the introduction and conclusion,the paper is divided into four parts.The first part,this paper proposes a definition of the concept of grass-roots dispute mediation in police station under the guidanc e of literature material,and analyzes the justification,nature,function and the trend of legalization of grass-roots dispute mediation.The second part,this paper summarize the characteristics of alert issues of dispute by Lhasa urban police station through data analysis method,analyze the present situation of the dispute mediation by using the cases and structured interview method from the four aspects of mediation: basis,methods,staff and results,and conduct empirical analysis of the effectiveness of the dispute mediation in the Lhasa urban police station.The third part,according to the status quo of dispute mediation in Lhasa police station,summarize the factors that restrict the play of the mediation function of the public security,such as the lack of legal basis for mediation,the low comprehensive mediation ability of the policeman,the poor operation in the linkage of cross department collaborative mediation of dispute and the absence of supervisory mechanism.The fourth part,the paper proposes some improvement suggestions based on the problems obtained from the investigation.First,clarify the authority scope and procedures of dispute mediation by police stations in the legal system to promote the legalization of dispute mediation.The second is that the public security organs should enhance the policeman’ Legal Literacy,improve training mechanism related to dispute mediation and enrich their mediation skills and methods to improve Comprehensive mediation ability of the policeman.Third,improve the internal and external linkage of dispute mediation by the public security organs,establish a grass-roots linkage of dispute mediation centered on the public security organs,clarify the authority,legal responsibility and operation of each department,aiming at change the problem of the poor operation of the linkage.Fourth,establish the normalized supervision mechanism to urge the police stations to regulate and legally operate the mediation mechanism by using various supervision ways.It is hoped that the research of this paper can provide constructive suggestions on regulating the grass-roots dispute mediation of public security police station in Lhasa,and further enrich the theory of Tibet’s diversified dispute resolution mechanism. |
