Research On The "Fake Authority" Of Police In The Mediation Of Police Station

Public security mediation is a very unique social governance system in China.It plays an important role in resolving conflicts and disputes at the grassroots level and is an important part of police work in police stations.In practice,public security mediation is not carried out in full accordance with the law,and there are many disturbing factors.Among these factors,the police's "fake authority" is often ignored by researchers because of its concealment.Studying the "fake authority" of the police in public security mediation can not only expand the theory and practice of police authority,but also help to fully understand the practice of public security mediation,and provide a possible explanation framework for the lack of effective public security mediation in practice.This research uses the literature research method,field investigation method,case study method and interview method,starting from the connotation and source of police authority,to build a theoretical framework of police "fake authority",on this basis,the operation of police fake authority in public security mediation and Conduct research on its hazards and put forward relevant suggestions for cracking down on the authority of police illusion in public security mediation.Police "fake authority" is essentially the improper use of police authority by the police.The public's recognition of the police authority is the basis for the police's "fake authority".The low familiarity of the parties with the law,the urgency of the parties to protect their own interests,and the performance evaluation of the grass-roots police station are important to the generation of the police "fake authority" influences.In order to further demonstrate the generation logic of the police's "fake authority",this study takes the J police station as an example to investigate and find that it is common for both parties to accept mediation and sign agreements based on the police's "fake authority" in police station mediation.The study found that the use of "fake authority" by the police has caused varying degrees of harm to police authority,the effectiveness of public security mediation,police-civilian relations,and police resources.Through the analysis of cases related to public security mediation,combined with indepth interviews with the police,it is found that the ambiguity of the scope of public security mediation,the lack of security capabilities of some police,the performance evaluation pressure of police mediation in the police station,the parties' blind obedience to police authority and the judicial settlement of exclusion cases are The main reason why the police use fake authority in public security mediation.To solve the problem of police illusion authority in public securitymediation,we need to proceed from the following aspects: first,to strengthen the voluntary principle of the parties by introducing a mandatory notification obligation and a repentance system;second,to highlight the public security mediation procedural regulation of police mediation behavior;third,give the security mediation agreement a certain legal effect to reduce the arbitrariness of the police and the parties;fourth,enhance the civilian police's ability to work and improve the skills of public security mediation;fifth,enhance the public's awareness of the legal system.
