| The incorporation of socialist core values into the law is an inevitable requirement for adhering to the combination of rule of law and rule of virtue,and is an important measure to achieve the modernization of China’s governance system and governance capabilities.Meanwhile,local legislation on civilized behavior,as a specialized and systematic legislation aimed at morality,is a local legislation with Chinese characteristics that has emerged to adapt to the development of the times.As an important component of the core values,"civilization" is highly consistent with the legal value and connotation of legislation in civilized behavior,and can effectively promote the implementation of mainstream ideology.The integration of socialist core values into local legislation on civilized behavior is a key aspect that needs to be studied and paid attention to during the legislative process.Through empirical analysis and induction of the local regulations on promoting civilized behavior announced by 206 cities with districts in China,from the aspects of formulation subject,distribution area,implementation time,nature of regulations,and content and style of provisions,it can be seen that the core values are mainly integrated into the local legislation of civilized behavior through the concept of rule of law,legislative purpose,legislative principles,legal norms,and other forms.This article selects Hangzhou as a typical regulation for local legislation on civilized behavior,and focuses on analyzing the social conditions and main characteristics of its legislation,in order to explore the current situation of formulating local legislation on civilized behavior in China.The basic pattern of local legislation on civilized behavior in China has been formed,but due to its own characteristics of promoting legislation and soft law,the lack of binding force in practice is the main problem.Analyzing the reasons for the lack of binding force in the sample of local legislation on civilized behavior in China is concentrated in three aspects: firstly,the provisions of local legislation on civilized behavior are too principled,resulting in unclear normative characteristics;Secondly,there is a lack of effective responsibility support and inadequate supporting measures for social services;Thirdly,it is difficult to implement incentive measures.In order to improve the accuracy and practical implementation effect of local legislation,enhance the operability of local legislation on civilized behavior,and ensure the effective implementation of legislative objectives,it is necessary to reduce overly principled provisions in local legislation on civilized behavior,enhance responsibility support,and construct incentive measures for local legislation on civilized behavior through sound legal reward mechanisms and actionable advocacy legal norms,Addressing the drawback of local legislation lacking binding force in the application of laws for civilized behavior. |
