Research On The Legislation Of The Promotion Of Local Civilized Behavior In China

The promotion of local civilized behavior regulations is a typical result of legalization of morality,its generation and development are driven by the need of improving the overall moral level of the society.The academic circle pays more attention to its legislative theory,but less to its implementation,let alone combining the theory with the implementation.This paper will consider both of the legislative level and implemental level of the promotion of local civilized behavior regulations,and start with clarifying its origin,development,current situation and other basic conditions.The purpose of which is to ensuring the promotion of local civilized behavior regulations could meet the needs of China’s modernization of social governance and the way to ’civilization’ by finding the breakthroughs of legislative and implementation dilemma faced by the promotion of local civilized behavior regulations as well as the improvement direction of the promotion of local civilized behavior regulations in the future.This paper is divided into five parts in structure.The first part is to find out that ’establish the civilized city’ and ’modernization of social governance’ are the key to generating,rapidly developing and even popularizing the promotion of local civilized behavior regulations by digging the origin basis of it from the logical and practical leap of ’civilization’ to ’the promotion of local civilized behavior regulations’;the second part is to comb the current situation of the promotion of local civilized behavior regulations,put forward the quartered separating method of the stylistic rules and layout of the promotion of local civilized behavior regulations,find out the ossified risk and ossifications and to pave the way for the discussion of legislative dilemma;the third part is to demonstrate the relevant legislative theories of the promotion of local civilized behavior regulations,clarify the basic concepts,respond the challenge of promoting legislation model,put forward the trichotomy of moral which adapts to the promotion of local civilized behavior regulations,put forward the demand of the legalization of morality from the perspective of the promotion of local civilized behavior regulations,and to conclude the triggers of legislative dilemma by combining with the written parts;the fourth part is to predict the path form the triggers of legislative dilemma to legislative dilemma then to implementation dilemma at first,then goes into the implementation aspect,analyze the implementation situation of the promotion of local civilized behavior regulations entirety then partly and then entirety again based on the deconstruction of the implementation pattern under the subjectival demand of modernization of social governance,then finding out the implementation dilemma by combining the theoretical demonstrations;the last part is to put forward the way of breakthroughs of legislative and implementation dilemma faced by the promotion of local civilized behavior regulations as well as the improvement direction of the promotion of local civilized behavior regulations in the future.
