| Since the 18th National Congress of the Communist Party of China,the local legislation of civilized behavior has become a more concerned issue in local legislation in recent years.With major changes in the major social contradictions,the people’s yearning for a better life,and the increasing demand for the construction of spiritual civilization,various localities have explored and formulated legal systems for the promotion of civil civilized behavior.The overlapping relationship between law and morality provides the feasibility for civilized behavior legislation,which can regulate uncivilized behavior through local legislation,promote the promotion of civilized concept and the wide spread of civilized behavior,and enable more and more cities to put civilized behavior promotion regulations into the legislative work.So far,234 provinces,cities divided into districts and autonomous regions have formulated regulations to promote civilized behavior.A review of 234 local legislations on civilized behavior shows that although local governments have promulgated and implemented regulations on the promotion of civilized behavior,and the basic pattern of local legislation on civilized behavior has taken shape,there are also major problems,such as blindly following the trend and copying the contents of the regulations,resulting in the lack of local legislative pertinence,wide scope of adjustment and unclear setting of legal responsibilities.From the legal nature,the regulation on the promotion of civilized behavior is a kind of "promotion" legislation,which should pay attention to the optimization of the quality of local legislation on civilized behavior,reflect the local characteristics,and focus on the key issues.This paper is divided into five parts.The first part of the introduction discusses the practical background of the enactment of civilization promotion regulations in local legislation,the significance of the study of civilized behavior local legislation and research summary,provides the practical background and theoretical research support for the local legislation of civilized behavior.The second part statistics the definition of civilized behavior in different places,the types and combination types of behaviors regulated in the regulations on promoting civilized behavior in different places,and summarizes the legal basis and legal basis of local legislation on civilized behavior,and discusses the legal basis and necessity of local legislation on civilized behavior.A third part analyses the present situation of the local legislation of civilized behavior of our country at the present stage,discusses the legislative purpose,the basic framework of the local legislation of civilized behavior,the adjusting scope of the local legislation of civilized behavior,and the setting of the legal consequence of the local legislation of civilized behavior.The fourth part mainly puts forward suggestions to improve the local legislation of civilized behavior,such as strengthening the pertinence of local legislation,setting the form of framework structure reasonably,delimiting the scope of morality into the law reasonably,clarifying legal responsibilities and paying attention to the construction of incentive system.The last part is the conclusion.The local legislature should consider the actual situation,pay attention to the quality of legislation and local characteristics,and constantly explore the way forward of the local legislation of civilized behavior. |
