In recent years,with the increasing complexity and changeability of labor-management relations in China,the relationship between enterprises and employees has become more diversified and complicated,and labor dispute cases have increased significantly and gradually presented a situation of difficulty in mediation.Since the promulgation of the Labor Law in 1995,the state has taken collective wage negotiation and the signing of collective contracts as an important mechanism for adjusting labor relations,which is conducive to the orderly participation of citizens in politics,which is of great significance to promoting the institutionalized development of consultative democracy in the process of modernization.Taking the Lanzhou Xigu District Federation of Trade Unions as an example,this paper analyzes that in the current wage collective bargaining,under the pressure of huge indicators of higher-level trade unions,local trade unions have problems such as low participation of negotiation subjects,poor performance supervision,formality of negotiation,low quality of collective contracts,and low awareness of employees in the performance of their functions,which makes collective wage negotiation show the characteristics of emphasizing quantity over quality,and emphasizing formulation over implementation,and collective wage negotiation has not really played a role.Based on the theory of consultative democracy and labor relations,this paper further analyzes the deep-seated reasons affecting the imperfect performance of local trade unions’ functions in collective wage bargaining from five aspects: insufficient subjectivity of labor and management,imperfect supporting system for consultation,irregular operation mechanism of consultation,insufficient bargaining power of negotiation representatives,and insufficient environmental atmosphere of consultation.Finally,through research and analysis,it is proposed that in collective wage bargaining,local trade unions should optimize the performance of duties through the following strategies: first,enhance the representation of labor and management,and ensure the independence and representativeness of trade unions by playing the "quasi-government" function of local trade unions;Second,improve the supporting system of collective wage negotiation,the supporting system of consultation and the supervision and inspection mechanism;Third,to improve the operation process of collective negotiation,it is necessary to change the objectives of consultation,simplify the consultation procedures,and change the methods of consultation;Fourth,cultivate the main body of negotiation of the old party,that is,cultivate the bargaining power of the labor side and improve the bargaining power of the labor representative;Fifth,create an atmosphere of consultation environment,condense the consensus of collective consultation,and expand publicity strategies.Through the above aspects,the optimization of the performance of local trade unions in collective wage negotiation is completed. |
