Be established in the theory and practice of the regional collaborative legislation of the Chishui River Basin protection Regulations jointly established by Yunnan,Sichuan and Guizhou provinces,this paper analyzes the regional collaborative legislation in Yunnan,Sichuan and Guizhou,and fully draws lessons from the collaborative legislative system construction,the selection of the mode in other regions in China based on the successful experience of mechanism improvement and the reality of regional collaborative legislation in Yunnan,Sichuan and Guizhou,this paper point out the direction.This paper is divided into six parts:The first part is the introduction,which summarizes the background of collaborative legislation in Yunnan,Sichuan and Guizhou provinces and puts forward the questions studied in this paper,that is,what are the characteristics of the regional collaborative legislation mode currently adopted by the three provinces compared with Chengdu,Deyang,Meishan,Ziyang and other regions? Can this model be applied to regional collaborative legislation of Yunnan,Sichuan and Guizhou in other fields besides Chishui River Basin protection? What problems still exist in regional collaborative legislation in Yunnan,Sichuan and Guizhou? And so on.The second part is the basic theory of cooperative legislation in Yunnan,Sichuan and Gguizhou area,including the definition of basic concepts,synergy theory and regional development theory as the rule of law in the three provinces of cooperative legislation to provide theoretical support,the feasibility and necessity of realizing the unification of local legal system.The third part is to sort out the only current regional collaborative legislative activities in Yunnan,Sichuan and Guizhou.Three provinces have only jointly established the Chishui River Basin protection regulations.The reason why the three provinces extend the collaborative legislation into joint legislation is based on the consideration of the actual situation of the three provinces.The fourth part is a typical regional synergy to domestic legislation mode of sample(or mechanism),and sums up the experience for finding out the problem that still exist in Yunnan,Sichuan and Guizhou.,including the basis of superior law is not perfect,the scope of legislation lacks universality and the model is simplex.The fifth part summarizes the main process,background and the establishment of collaborative legislation mode selection of the Beijing-Tianjin-Hebei,the Yangtze River Delta and Chengdu,Deyang,Meishan and Ziyang city,which is the region that explored collaborative legislation earlier in China and established various joint conference mechanisms.The promulgation of various documents can provide experience for Yunnan,Sichuan and Guizhou regional collaborative legislation;Chengdu,Deyang,Meishan and Ziyang city is the latest in Sichuan province to carry out the cooperative legislation,to strengthen the city of four market development is their goal.The last part is the path selection of regional collaborative legislation in Yunnan,Sichuan and Guizhou.This chapter is based on the problems that still exist in Yunnan,Sichuan and Guizhou Province,to provide path selection for three provinces,including to authorized in the law,to establish a sound collaborative legislative mechanism and to establish information exchange platform,and so on. |
