With the implementation of the "Yangtze River Protection Law",my country has ushered in new opportunities for development in river basin legislation.Among them,improving the intergovernmental cooperation system is an indispensable part of river basin legislation.Since the Yangtze River Basin spans multiple provinces and autonomous regions,and the interests of various regions are complex,it is necessary to establish an effective intergovernmental cooperation mechanism to coordinate the interests of all parties and promote the effective implementation of river basin governance.In the legislation of the Yangtze River Basin,the intergovernmental cooperation system can play a vital role.Through the establishment of a cross-regional,cross-departmental,and cross-field joint collaboration mechanism,communication and exchange between various regions can be strengthened,cooperation and coordination can be promoted,and various river basins can be guaranteed.Effective implementation of governance measures.This article discusses the theoretical basis for the existence of the intergovernmental cooperation system in the Yangtze River Basin by defining the concepts related to the intergovernmental cooperation system in the legislation of the Yangtze River Basin,and expounds the necessity and possibility of the intergovernmental cooperation system in the Yangtze River Basin.On the basis of explaining the research on the status quo of the intergovernmental cooperation system in the water legislation of the Yangtze River Basin and the river basin legislation,and analyzing the shortcomings of the intergovernmental cooperation system in the Yangtze River Basin,the problems existing in the existing intergovernmental cooperation system are explained.In the concept of intergovernmental cooperation,it is interpreted that the lack of integrated management of the river basin brought about by the management concept of "administrative classification",the weakening of intergovernmental cooperation and the self-interest of regional management brought about by the management concept of "combining river basin management and regional management",Closed,the existing intergovernmental coordination mechanism has intersections and contradictions,and the legal system of the Yangtze River Basin involves the deformity of the legal norms of the basin as a whole.The author puts forward a reasonable solution to the above-mentioned problems by thinking about the above problems and studying relevant literature.Thirdly,it innovatively summarizes the intergovernmental cooperation models of highly centralized management,decentralized cooperative management and relatively centralized management in the Tennessee River Basin,the Mississippi River Basin and the Murray-Darling River Basin in the legislation of extraterritorial watersheds,and conducts an analysis of the experience of related models.After analysis and thinking,it is believed that the intergovernmental cooperation model under the relatively centralized management system is suitable for intergovernmental cooperation in the Yangtze River Basin in my country for reference.Finally,the author believes that the level of intergovernmental cooperation and water governance can be improved by unifying the concept of intergovernmental cooperation,improving the establishment of intergovernmental cooperation institutions,improving the existing intergovernmental cooperation system and relevant intergovernmental cooperation legislation in the Yangtze River Basin.By exploring the problems of the intergovernmental cooperation system in the Yangtze River Basin and proposing corresponding solutions,the level of intergovernmental cooperation can be effectively improved,which is conducive to the effective implementation of river basin governance and the in-depth development of my country’s river basin legislation process.,to achieve sustainable development of water resources in the Yangtze River Basin. |
