Legislative Research On Family Education For Minors In Difficulty

Minors in difficulty refer to the minors who have difficulties in receiving family education and need special protection due to their own factors,parents or other guardians,which are divided into their own predicament,the absence of family education and the improper family education.Through the standard analysis,it is found that the family education legislation has problems such as the unclear scope of minors,the lack of legal provisions of special management institutions,and the unclear scope of the implementation subject and legal responsibility of family education.In reality,minors in difficulties are faced with many difficulties,such as the weakening of family education function,the lack of targeted family education guidance services,and the lack of supervision and intervention of improper education behavior.To ensure the family education of minors in difficulties,we need to consolidate the educational responsibility of parents or other guardians and strengthen the leading role of the government.It is suggested that the Family Education Promotion Law clarify the concept and type of minors in distress,expand the scope of family education subjects to actual guardians;clarify the government responsibility to provide supportive services,supplementary services and alternative services;improve the family education guidance system,order parents or other guardians who improperly implement family education to receive family education guidance;and to increase the court,residents committee and villagers committee as the supervision subjects of family education of minors in distress.At the same time,in order to effectively stop the educational behavior of violence,it is suggested that the reporting responsibility of the compulsory reporting system in the Anti-Domestic Violence Law should be implemented to individuals,and the psychological and spiritual harm such as ignoring the emotional needs of minors,discrimination against minors,instigated crimes,derogatory personality,and privacy leakage are also listed as violence.Finally,it is necessary to formulate the supporting "Family Education Guidance Service Personnel Qualification Regulations",which is clearly for the families of minors in distress...
