| With the rapid development of new employment forms such as platform economy and sharing economy,the number of workers in new formats with flexible working hours and huge market demand has grown rapidly,becoming an important force for promoting economic and social development.Compared with the traditional employment model,the new flexible employment mode presents new characteristics in terms of working hours,workplaces,working methods,etc.,providing workers with more career choices,but also bringing about the problem of insufficient protection of workers’ rights and interests.It is mainly manifested in the lack of protection for workers in new employment forms in terms of labor remuneration,social insurance,rest,occupational safety and health rights and interests,and employment training.Effectively safeguarding the legitimate rights and interests of practitioners in new formats is not only a key issue to promote high-quality economic development,but also one of the key points to solve China’s future employment problems.Therefore,it is necessary to strengthen the protection of workers’ rights and interests,support and standardize the development of new employment forms,create a better development environment and occupational environment for workers,build harmonious labor relations,and promote the high-quality development of the platform economy.Through the combing and review of relevant materials on the protection of workers’ rights and interests in the new employment situation at home and abroad,this paper analyzes the flexible employment forms of new formats and the employment characteristics of workers in new formats,and sorts out the relevant expositions of classic Marxism and Chinese Marxism on the protection of workers’ rights and interests.The problems arising from the aspects of labor remuneration rights,social insurance rights,rest rights,labor safety and health rights and interests,and employment training rights and interests protection are specifically expounded,the reasons for the damage to the rights and interests of workers in new formats are analyzed in depth,and the path of protecting the rights and interests of workers in new formats is put forward in a targeted manner.This paper mainly discusses the following five points:The first part:This chapter introduces the research background and significance of the paper,summarizes the current research status at home and abroad,and points out the research ideas,methods,innovations and shortcomings of this paper.The second part: This chapter first explains the relevant concepts,and defines the core concepts of this paper by analyzing the characteristics of the flexible employment model of the new format.On this basis,the relevant expositions of classical Marxism and Chinese-style Marxism on the protection of workers’ rights and interests are sorted out and summarized.The third part: Problems in the Protection of Workers’ Rights and Interests in New Employment Forms.The problems faced by workers in the new employment form are analyzed from five aspects: the right to labor remuneration,the right to social insurance,the right to rest,the right to occupational safety and health,and the right to employment training rights.The fourth part:The reasons for the damage to the rights and interests of workers in the new employment form.This chapter comprehensively analyzes the reasons for the damage to the protection of workers’ rights and interests in new employment forms from the aspects of governments,enterprises,trade unions and individual workers,mainly including: lack of legal regulation of new forms of employment,inadequate implementation of social insurance system,lagging industry supervision and governance,irregular enterprise safety management,and insufficient supply of vocational skills training services for workers.The fifth part:The path to protect the rights and interests of workers in new formats.Countermeasures are proposed to solve the problems existing in the rights of workers in new industries in terms of labor remuneration rights,social insurance rights,rest rights,occupational safety and health rights and interests,and vocational skills training rights and interests.To strengthen the protection of the rights and interests of workers in new formats,it is necessary to improve the wage payment guarantee system for workers in new formats,expand the coverage of social insurance for workers in new formats,strengthen the dynamic supervision of employment of platform enterprises,implement the main responsibility of labor security of platform enterprises,and optimize vocational skills training services for workers in new formats.By exploring issues related to the protection of workers’ rights and interests,this paper deepens the understanding of the concepts of flexible employment,new format workers and workers’ rights and interests,and enriches the relevant discussions on the protection of workers’ rights and interests.It is conducive to deepening the development of labor relations related theories in the era of digital economy,and is of great significance for building harmonious labor relations and promoting the high-quality development of platform economy.The innovative ideas of this paper are as follows:On the one hand,there is a lot of research on platform gig workers represented by delivery workers and online ride-hailing,but most of them focus on the legal issues between platforms and workers,mainly from the perspective of law,focusing on the problem of insufficient legal protection of workers,and exploring how to determine the labor relationship between platforms and workers.Based on the relevant expositions of classical Marxism and Chinese-style Marxism,this paper deeply explores the employment methods and labor rules of the platform,and discusses the problems,causes and countermeasures faced by the protection of the rights and interests of workers in the new employment form.On the other hand,This paper analyzes the performance of the damage to the rights and interests of workers in the new employment form from five aspects: labor remuneration right,social insurance right,occupational safety and health right and right to rest,and vocational skills training right and other aspects,and attempts to comprehensively think about countermeasures from the dimensions of government,platform enterprises,society and workers themselves in the path selection of the protection of workers’ rights and interests in new employment forms.In view of the lack of protection of workers’ rights and interests arising from the development of new business formats,explore feasible measures for multi-subject cooperation from the aspects of system improvement,policy implementation,organizational guarantee,and industry self-discipline. |
