Comparative Research On Local Policies For Protection Of Labor Rights And Interests Of New Employment Forms

In recent years,new employment forms have grown rapidly,bringing a large number of employees such as online delivery drivers,online car drivers,and webcaster.Because of its highly flexible character,workers in the new form of employment are facing large violations of labor rights and interests.In order to safeguard the labor security rights and interests of workers in new forms of employment effectively,and promote the healthy and sustainable development of the platform economy,Ministry of Human Resources and Social Security and local governments have successively promulgated related policies for the protection of labor security rights and interests of workers in new forms of employment since July 2021.This paper conducts a comparative study on the labor rights protection policies of new employment forms in 29 provinces(municipalities and autonomous regions),summarizes the characteristics and problems of the policies,and make suggestions for the optimization and adjustment of labor rights protection policies for new employment forms.It helps to promote the formation of a good labor order and provide support for effective social governance.Methods,such as literature analysis,policy text content analysis and comparative analysis,are conducted in this research based on theories of government intervention,institutional innovation and public policy value.Nvivo12 qualitative analysis software is used to analyze the policy text,policy tools and policy goals with high reliability and validity.It is found that local governments have successively issued labor rights protection policies for new employment forms within one year in accordance with the requirements of the Ministry of Human Resources and Social Security’s Guiding Opinions on Safeguarding the Labor Security Rights and Interests of New Employment Forms of Workers.Comprehensive policy tools are used by all local governments.Compulsory policy tools with greater government intervention account for a higher proportion,while voluntary policy tools with greater market self-regulation account for a lower proportion.Policy tools match the requirements for achieving policy goals.The goals of the policies are in line with the development requirements of human and social undertakings of the Ministry of Human Resources and Social Security’s "14th Five-Year Plan",which fully shows that all local governments attach the protection of labor rights and interests of workers in the new employment forms to the development of the career of the national resources and social security.At the same time,there are still problems such as inflexible policy forms,unbalanced use of policy tools,and unquantified policy objectives in the labor rights protection policies of new employment forms.All localities should pay attention to the sustainability of policies and the possible associated impacts,fully combine the development status of local new employment forms,the functions of government departments,and the political,economic,geographical environment,and pay attention to the self-organization and spontaneous regulation of the market while increasing government intervention.In order to effectively safeguard the labor security rights and interests of local workers in new forms of employment,and form positive policy support roles,they should formulate executable quantitative policy objectives with detailed research,consultation and demonstration.
