Research On Government Supervision Of Online Fundraising Platforms

In 2016,China promulgated the Charity Law of the People’s Republic of China,which defined online fundraising platforms for the first time and stipulated the use of platforms by charitable organizations to carry out fundraising.The promulgation of the Charity Law of the People’s Republic of China marks a new period in the development of online fundraising platforms.In 2017,the government issued the Basic Management Specifications of the online Fundraising Platform for Charitable Organizations and the Basic Technical Specifications of online Fundraising Platform for Charitable Organizations,which provided a basis for government supervision.With the advancement of government supervision of online fundraising platforms,some problems in supervision have gradually emerged,and if they are not handled well,they will inevitably have an adverse impact on China’s public welfare undertakings.Based on government regulation theory and the theory of responsive supervision concept,this paper uses the literature research method and interview method to sort out four problems,mainly including insufficient coordination of government supervision entities of online fundraising platforms,low transparency of government supervision process of online fundraising platforms,single lag in the government supervision method of online fundraising platforms,and limited government supervision and punishment effect of online fundraising platforms.In view of the above problems,the main reasons for their occurrence are that the government supervision of online fundraising platforms is constrained by traditional concepts,the legal basis for government supervision of online fundraising platforms is not perfect,the coordination system of government supervision of online fundraising platforms is not perfect,and the government supervision methods of online fundraising platforms are path dependence.To this end,when the government supervises online fundraising platforms,it can update the government supervision concept of online fundraising platforms,optimize the government supervision laws and regulations of online fundraising platforms,improve the network system of coordinated supervision of online fundraising platforms,and enrich the government supervision methods of online fundraising platforms.It will not only help standardize the operation of online fundraising platforms,but also help to maintain the bottom line of openness,transparency and integrity of basic public welfare undertakings,and ultimately promote the development of China’s philanthropy.
