Research On The Regulation Of Online Fundraising For Charity In China

With the rapid development and comprehensive popularization of Internet technology,online fundraising came into being.This emerging model expands the development space of traditional charity fundraising and promotes the development of Internet philanthropy.However,in recent years,the phenomenon of online fundraising is out of the norm,and the phenomenon of Internet fraud and donation such as "the same birthday incident" and "the LuoEr incident" have seriously affected the credibility of internet charities,has cast a shadow over its development.In order to solve these problems,relevant departments have issued a series of laws,regulations and system norms,to strengthen the regulation of online fundraising.Although it has achieved certain regulatory results,it has not completely solved the problem of effective regulation of online fundraisingThis paper focuses on the regulation of China's online fundraising,and adopts the research methods of interview method and case analysis method.First of all,the paper combs the development status of online fundraising,and combines with the current practice of online fundraising regulation,summarizes and analyzes the limitations of China's online fundraising regulation.Secondly,based on the recognition of the advantages of responsive regulation theory,it further explores the applicability of responsive regulation in China's online fundraising regulation,and reflects the regulation practice of China's online fundraising in combination with the theory of responsive regulation.Finally,this paper proposes ways to further optimize China's online fundraising regulation.The study found that the limitations of China's online fundraising regulation mainly include four aspects:lagging regulation concept,insufficient regulation subject capability,overly strict regulation mode and weak self-regulation.By analyzing the applicability of responsive regulation theory in China's online fundraising,it can be seen that both in functional sense and practical sense,responsive regulation theory has strong practical significance.Drawing on the idea of absorbing responsive regulation can help break through the current limitations of regulation and improve the regulation efficiency of online fundraisingThe study believes that,from the perspective of responsive regulation,the ways to further optimize China's online fundraising regulation in the future can be explored from three major aspects.Firstly,optimizing government regulation,it mainly including establishing the concept of responsive regulation,optimizing regulation methods,improving the professional quality and collaboration capabilities of law enforcement teams,and further improving the legal supporting mechanism.Secondly,strengthening the self-regulation of non-government subjects,and giving play to the regulatory role of charitable organizations and online fundraising platforms.Finally,giving full play to the positive energy of social regulation,and attaching importance to the role of public opinion regulation of the public and the news media.
