Research On The Management Of Short Term Prisoners In X Prison Of Yunnan Province

In the practice of China ’ s prison management,criminals sentenced to a fixed-term imprisonment of less than 3 years(including 3 years)are collectively referred to as short-term criminals.In recent years,the proportion of short-term criminals in custody has gradually increased.According to statistics from the judicial department,as of January 31,2022,the number of short-term criminals in custody in China accounted for 27.6% of the total number of criminals in custody.In Yunnan Province,the number of short-term criminals in custody accounted for 28.8% of the total number of criminals in custody;the number of short-term criminals in custody who have served two or more prison terms accounted for 46.2% of the total number of short-term criminals in custody.At present,there are few theoretical research results on the management of short-term criminals,and there is no professional and systematic management method for short-term criminals in reality.In addition,the complicated situation of short-term criminals brings great difficulties to the supervision and reform of criminals.In-depth research on the management of short-term criminals is carried out,to provide theoretical assistance for improving the management of short-term criminals,summarize and establish a professional management mechanism of short-term criminals,and truly improve the quality and level of the management of short-term criminals,and provide a reference for the management of short-term criminals in Yunnan Province and even the whole country.The short-term criminals in X Prison in Yunnan Province are taken as the research object of this paper.First of all,literature and books related to criminal management are consulted,to collect and sort out the criminal management systems and methods,as well as the status quo of short-term criminal management.At the same time,the concepts of criminals,short-term criminals and criminal management are clarified.Secondly,the interview method and statistical analysis method are used in the research in this paper.The files of short-term criminals in X Prison in Yunnan Province are sorted out and analyzed,and the middle-level management cadres,the police of functional departments,and the front-line grassroots police,etc.in the prison are interviewed,to clearly understand the status quo of short-term criminal management in X Prison in Yunnan Province,and analyze its existing problems.Mao Zedong’s theory of reforming criminals,collaborative governance theory,and Maslow’s hierarchy of needs are used to discuss the establishment of a working mechanism for the management of short-term criminals.The research found the following issues: first,most of the short-term criminals in X Prison in Yunnan Province had no proper employment,low education level,poor legal awareness,lack of family care and family education,poor awareness of rules and self-discipline before they were arrested,with a high proportion of recidivism.Second,management system for short-term criminals is not perfect,and the building of laws and regulations in supervision,education and labor management lags behind;criminals resist the reform;closed working environment and heavy supervision pressure,etc.result in a clear sense of job burnout among prison police officers.Third,a special prison area is arranged for the management of short-term criminals,and relevant personnel are specially responsible for the management of the reform of short-term criminals.Besides,a short-term criminal management system mechanism and reform quality evaluation system should be established and improved,the building of the prison police team should be strengthened,to achieve good results in the management of short-term criminals.Fourth,the management of short-term criminals must be carried out according to the Mao Zedong’s theory of reforming criminals,and the people-oriented concept.The policy of combining punishment and reform must be implemented in the management of criminals to ensure the coordination of supervision,education and labor management;the theory of collaborative governance should be used to ensure the harmonization among multiple subjects,and the criminals ’ medical treatment,commutation of sentences,and employment training are carried out in an orderly manner,so that the goal of criminal management is jointly completed by all subjects.Restricting or meeting the needs of criminals in purchasing daily items,family calls,family meetings,and auxiliary positions to motivate the criminals,and mobilize their enthusiasm to reform;the three theories should be effectively used to build a short-term criminal management mechanism and jointly achieve the goal of effective criminal management.
