On The Improvement System Of China’s Community Correction Procuratorial Supervision

In the community-based community correction activities,the procuratorial authorities exercise their supervisory powers in accordance with the law,supervise the supervised subjects to perform their duties in accordance with the law,and play an important role in the steady development of community correction work,community correction subjects to rehabilitate and re-enter society,at the same time,the procuratorial authorities do a good job in the legal supervision of community correction,which is of great significance to the development of the procuratorial system in the new era.Research community correction procuratorial supervision system also has theoretical research value.However,the community correction procuratorial supervision mechanism in the process of operation,reveals a number of problems.First,the Community Correction Law has fewer provisions for procuratorial supervision,mainly covered in Article 62,there are no clear provisions for procuratorial supervision intervention time,supervision process,etc.Second,there is a deviation in the positioning of community corrections supervision,supervision workers confuse the role of "supervisor" and "manager" phenomenon,become the "supervisor" of community corrections The "supervisors" are the "supervisors" of community corrections,and they may overstep their authority and reduce the credibility of state organs.Third,the community correction procuratorial supervision method seems backward and passive,the procuratorial organs often adopt a formalized supervision mode,but neglected to "change the place of implementation" and "application for out" and other important aspects of supervision.Fourth,the procuratorial supervision team lacks professional talents,especially the grassroots procuratorial organs,lack of human,financial and material resources for procuratorial supervision.Finally,the community correction procuratorial supervision of big data technology is not yet mature,including the time of community correction work and procuratorial supervision of information is not synchronized,the space of cross-regional community correction information sharing mechanism is not perfect.All these problems affect the development of the community correction system and the procuratorial supervision system.The improvement of the community correction procuratorial supervision system should start from the following aspects: First,for the problem of procuratorial supervision of the relevant laws and regulations in general,should clarify the supervision process,refine the applicable conditions and legal effect of the supervision means,and strengthen its legal status.The main body of community correctional supervision of minors should be different from adults,by the Department of juvenile prosecution.Second,the procuratorial organs should accurately grasp the positioning of the procuratorial supervision function,to avoid becoming the "manager" of community correction activities.Third,the procuratorial organs should be innovative "focus on supervision,taking into account the overall supervision" supervision concept,for key aspects of increased supervision.At the same time,innovative mode of procuratorial supervision,in the grassroots level to improve community correction procuratorial office,improve the initiative and target of procuratorial supervision.Establish a system of rewards and punishments for procuratorial supervision to improve the motivation of procuratorial supervision staff.Fourth,in response to the lack of professional supervision personnel,on the one hand,through the improvement of community correction work and the guarantee mechanism of procuratorial supervision,on the other hand,through strict hiring standards and functional training,annual assessment and other ways to improve the professionalism of the community correction procuratorial supervision team.Finally,the construction of intelligent prosecution services should be accelerated,and efforts should be made to create a large information and data office platform containing community correction work and procuratorial supervision work on a provincial basis.In addition,the cross-regional community correction procuratorial supervision information sharing mechanism should be improved.Realize dynamic and timely information sharing in time and space.
