Research On Regulation And Improvement Of Community Correction Prosecutorial Supervision

Community correction is a kind of punishment corresponding to imprisonment.It is an open transformation method which uses multiple forces to continue to execute penalties in the community,prompt criminals to correct crimes,and return to society.It should also be included in the supervision of the procuratorate.But for now,prosecutorial supervision of community correction still faces many problems and dilemmas,such as deviation of work positioning,insufficient staffing,implementation of passive lag,insufficient multiparty coordination,measures without any variation,lack of legal basis,etc.As for how to improve and innovate the prosecutorial supervision of community correction,there have been many articles in the academic circle to explore in theory and academics,but the discussion from the practical experience of prosecutorial supervision is still insufficient.What's more,from the perspective of our whole country,it is rare to explore the supervision mode with regional characteristics.This article intends to carry out specific instance analysis based on the author's practical experience in community correction of supervision in Shanghai.With theoretical analysis to carry out full exploration and research,in order to explore how to unleash and improve the supervision function of the procuratorate,and make the community corrections achieve the desired goal.The full text is divided into four parts.Introduction,summarizing the theoretical background of community correction research,and the research status of community correction and prosecutorial supervision.The first chapter summarizes the concept and significance of community correction and confirms the principle and value of community correction.At the same time,summarizing and drawing on the experience and achievements of extraterritorial community correction and supervision work.The second chapter,combined with the development history and work status of community corrections and supervision work in China,analyzes the current situation of the community correction and supervision system in Shanghai,summarizes a series of dilemmas and problems,and analyzes the causes of its combination of theory and practice.The third chapter,corresponding to the above research and analysis,proposes a series of countermeasures and reflections on regulation and improvement,wishes to contribute to the future development of community correction and supervision in China.
