Research On Special Correction Education System For Juvenile Delinquency

As a result of the Amendment to the Criminal Law of the People’s Republic of China(XI),the minimum age of criminal responsibility was decreased to 12 years old,and the system of "institutionalization" was changed to one of "special correctional education." Teens and young adults have high plasticity,and their unique physical and mental traits dictate that their educational and therapeutic objectives should vary from those of adults.Because of this,juveniles and young adults need distinct educational and therapy objectives than adults.The construction and improvement of the special correctional education system for juvenile delinquency is a systematic and comprehensive undertaking with both vertical and horizontal efforts,which represents a qualitative leap forward in China’s approach to juvenile crime.Based on the idea that "teaching" is both the beginning and the final point,it is time to increase the level of professionalism,specialization,and stability in correctional education,as well as to develop a correctional education system that is both relevant and targeted.Due to the fact that juvenile delinquency is a global concern,all governments take proactive efforts to prevent it from occurring and to give adolescents who have committed crimes with the appropriate education and correction.The development of specialized correctional education in China can be divided into three stages: the non-standardized stage,the survival stage of the institutionalization system,and the transformation stage from the institutionalization system to the specialized correctional education system,which has gone through a process from non-existent to existing,from shallow to deep,from decentralized to systematic,and from informal to formal.During the early period after the foundation of China,the specialized correctional institutions for delinquent minors were established in China,and they have been successful in saving a large number of delinquent minors in long-term correctional practice.However,with the development of society,the previous measures for the disposal of delinquent minors have fallen behind the times.The specialized correctional education has the following issues: in terms of physical conditions,there are deficiencies in the age of the applicable object and unclear conditions of application;in terms of procedural design,the decision procedure is unreasonable,the relief procedure is uncoordinated,and no supervision mechanism has been established;in terms of the implementation system,the criteria for the construction of the implementation site are unclear,the measurability of the implementation site is ambiguous,and the measurability of the implementation site is unclear.The above issues have deeply affected the special correctional education of juvenile delinquency to achieve considerable development in our country."Institutionalization" has been replaced by "specialized correctional education" in China for the first time in its history.We should note that there has been a change in both the name and the idea,underlining the need of moving ahead and avoiding juvenile delinquency,which is a significant study topic at the present time.To that end,this thesis will begin with the origins and development trajectory of the special correctional education system for juvenile delinquency and draw on international experience in order to investigate the special correctional education system for juvenile delinquency,analyze its shortcomings in legislation and justice.And then also puts forward countermeasures and suggestions from the following aspects,including the hierarchical and classified management,clarifying the application and the executive organs of specialized correctional education,taking the road of adjusting measures to local conditions,and strengthening the supervision of all parties.
