Research On The Construction And Optimization Of Grass-roots Dispute Mediation Center

At present,China’s society has entered a critical period of reform and development.With the continuous advancement of urbanization,the accelerated transformation of new and old kinetic energy of economic development and the further popularization of new technologies such as Internet artificial intelligence,the social structure,interest pattern and ideas have undergone profound adjustments and changes.Contradictions and conflicts in the new stage are characterized by diversified subjects,complicated objects,diversified types,large-scale groups,network communication and difficult mediation.If they cannot be resolved in time,they will easily turn into social conflicts and lead to social risks.However,the traditional single social contradiction mediation method has been unable to solve the current complex social contradictions,and it is not enough to adapt to the requirements of the current new social pattern and changes in the new situation.Since 2020,local governments,mainly represented by Zhejiang,Shandong and Anhui,have vigorously promoted the construction of multi-level Dispute Mediation Center,making it the terminal for resolving contradictions and disputes,which has gradually expanded to all parts of the country and become an important practice of grassroots social governance innovation.However,the academic research on Dispute Mediation Center is still a little insufficient,Therefore,it is worth researching how to better build Dispute Mediation Center and play its role.Especially in Zhejiang Province,the construction of Dispute Mediation Center is a major innovation measure to explore the "run once at most" reform of social governance in Zhejiang Province,and it has become a symbol of its "important window".Therefore,it is typical and representative to choose a grass-roots Maodiao Center in Shaoxing as the research object.Since the pilot construction of the mediation and resolution center of social contradictions and disputes at the town level in Zhejiang Province in 2020,Ke Yan Street in Keqiao District,Shaoxing City has made every effort to take the construction of the Dispute Mediation Center as a landmark project to show the governance level and effectiveness of Ke Yan,and to build the "Ke Yan Model" of Dispute Mediation Center by integrating multiple networks,which has realized the diversification of social contradictions and disputes,such as "one door only","one package" mediation,"one-stop service" and "one-stop".Therefore,this study takes Keyan Dispute Mediation Center,a new entity organization,as the research object,and from the theoretical perspective of holistic governance,constructs a "structure-process-function" analysis framework to explore its operating mechanism.On the basis of a deep understanding of the current situation,types and causes of conflicts and disputes in grass-roots society,this study comprehensively analyzes the establishment process,organizational structure,operating process,practical scheme and social value of Dispute Mediation Center in Ke Yan by means of field investigation,case file analysis and in-depth interviews,fully show the panorama of the construction and operation of a street-town-level Dispute Mediation Center.At the same time,however,the operational mechanism of Keyan Dispute Mediation Center also faces difficulties such as the awareness and participation of the masses need to be improved,the construction of the conflict mediation team is relatively weak,the implementation rate of the conflict mediation agreement is low,the prevention of grass-roots conflicts is not paid attention to,and the mediation methods are challenged.Based on this,the thesis finally puts forward some policy suggestions for Dispute Mediation Center : first,strengthen publicity and guidance,expand awareness and participation,and second,improve the team building.To improve the degree of mediation specialization,the third is to promote the change of ideas and realize the source governance of contradictions;the fourth is to improve the legal basis and enhance the authority of conflict mediation;the fifth is to innovate ways to resolve conflicts and adapt to the new environment of social governance,so as to enrich and expand the research on the multi-contradiction mediation mechanism at the grass-roots level,and then provide reference for promoting policy diffusion,innovating grass-roots governance and improving the ability of local governments in China to resolve social conflicts at the grass-roots level.
