The outbreak of the COVID-19 has put a lot of pressure on public health and public safety,and caused major inconvenience to social activities.In the fight against COVID-19,everyone actively or passively participated in it,which affected the COVID-19 and was also affected by the COVID-19.The role of individuals in the prevention and control of the COVID-19 may be positive or negative.New coronary pneumonia is highly contagious and can even cause death.From a global perspective,as of September 2021,about 228 million people have been infected with COVID-19 and 4.68 million have died.This sudden outbreak has had a huge impact on the world economy and people’s lives.Compared with the general law,the criminal law is guaranteed by the state’s coercive force,and the criminal law has a strong guiding and standardizing role in people’s behavior.In the process of the whole people actively fighting against the COVID-19,a small number of people took advantage of this to carry out illegal activities.Some people produce and sell counterfeit and inferior security products in the anti-epidemic work;some violate the quarantine prohibition in the anti-epidemic work;some attack the staff in the anti-epidemic work.Such behaviors endanger the domestic epidemic prevention order.Criminal law is one of the legal guarantees for anti-epidemic work and an effective legal tool for maintaining social stability.The criminal law has a positive effect on the fight against the epidemic,and the criminal law has rules for most people,so that social activities and anti-epidemic work can be carried out in an orderly manner.The criminal law punishes a small number of people,thereby warning the public.The first chapter focuses on the role of criminal law in the epidemic.In this chapter,I first described the development process of the COVID-19,discussed the harmfulness of the COVID-19,and pointed out a series of illegal problems discovered in the process of fighting the epidemic.Then it focuses on the guiding and punitive functions of the criminal law in the prevention and control of the COVID-19.The second chapter analyzes five common crimes in crimes involving epidemics.The specific crimes are analyzed from the aspects of constituent elements,difficulties in judicial application,and differences between crimes.The third chapter focuses on the limitations of criminal law and corresponding criminal policies under the epidemic situation.The law itself is lagging,the relevant laws for crimes related to the epidemic are not perfect,and there are difficulties in defining the crime and non-crime of illegal acts.It is pointed out that attention should be paid to the formation of a hierarchical criminal law system.Adhere to the criminal policy of both leniency and strictness,refine the judgment rules,and pay attention to the post-protection role of the criminal law.But at the same time,we must adhere to the law of crimes and punishments,not let go of a criminal,and not let innocent people be prosecuted.Finally,although the domestic epidemic prevention and control is very good,in the face of the COVID-19,we should still adhere to the criminal policy of combining leniency and strictness,adhere to a hierarchical criminal law system,adhere to the statutory crimes and punishments,and accurate justice for epidemic prevention activities.Escort.
