Research On Legal Issues Of Online Takeaway Food Safety Supervision

Since ancient times,food safety has been a top concern of the people.From food and clothing to the pursuit of a better life,ensuring food safety is to maintain the hard-won foundation of a happy life.With the rapid development of Internet platform economy,online takeout,a way to enjoy all kinds of food without leaving home,is widely favored by the public.By 2020,China’s online takeout users have grown to nearly500 million people,nearly 8 million delivery personnel,and the market size has reached more than 600 billion yuan,an increase of 30 times in ten years.Online takeaway food,a new catering mode,is changing Chinese people’s way of life with its advantages of convenience and speed.However,in recent years,there have been frequent incidents of takeaway food safety,such as spitting by salesmen,poor hygiene conditions of small takeaway workshops,and operation of black workshops without licenses,which make people sigh.2015 years later,the food safety law "," network investigate way on food safety violations,the measures for the supervision and administration of food and beverage service network,developed the local related regulations,for the healthy development of the industry of our country network delivery provides guidance law,a certain degree to network delivery to guarantee the healthy diet of consumers.However,due to network take-out industry developing rapidly,network take-away food safety regulatory challenges emerge in endlessly,some laws that are ambiguous,lack of corresponding elaboration standard,administrative enforcement,lead to network take-away food safety still didn’t get effective regulation,also appeared in the practical application situation of law is difficult to implement.This paper takes the problems existing in online takeaway food safety supervision as the research object.Firstly,it starts with the overview of online takeaway food safety supervision,defines the concepts of online takeaway food,online takeaway food safety and online takeaway food safety supervision,and analyzes the characteristics of legal relations of online takeaway food trading and the legal basis of supervision.Secondly,the current online takeout food safety supervision legal norms,industry standards,government supervision system and other legal systems are sorted out,and the status quo of the industry is revealed through social hot cases,and the problems existing in market access,food processing and distribution of online takeout food safety supervision are summarized.Then analyze the causes of these legal problems from the perspectives of legislation,law enforcement and supervision pattern.Finally,from the aspects of perfecting legislation,strengthening law enforcement and promoting social co-governance,this paper puts forward some legal suggestions on improving China’s online takeaway food safety supervision,and seeks to create a more rigorous legal system and supervision system for online takeaway food safety to protect consumers’ online takeaway food safety.
