Research On China’s Energy Security Legal System

Energy IS the driving force of human civilization and social progress,and human production and life are closely related to energy.In modern society,energy security is an important issue related to national sovereignty,security and development interests.To ensure national energy security,it is necessary to establish and improve the legal system of energy security.In recent years,an energy security system has been preliminarily established in our country,but on the one hand,these laws do not cover all energy security field,on the other hand,some of these laws and regulations exist only in drafts or draft opinions.This paper discusses and studies the legal system of energy security,aiming to analyze the problems and shortcomings of the system,and put forward suggestions on how to build and perfect the system.Firstly,this paper gives an overview of the legal system of energy security,introduces the concept of energy security,lists the different views of the academic world on energy security,and clarifies its own views according to the results of the scholars’ research and the reality of China.Moreover,it points out the necessity of studying the legal system of energy security according to the present situation of energy security system and domestic and foreign countries.Secondly,the author introduces the present energy security legal system in China as well as the related regulations and its shortcomings.The legal system of energy security in China has a certain system,but it still has many positive effects in all aspects.Lack of key laws and regulations,emergency,reserve,coordination,consumption and other systems are not perfect,lack of international cooperation and other defects make the existing energy security system in China far from enough to deal with the energy risks that may break out at any time.In view of these shortcomings,the author believes that improving the legal system of energy security should start from formulating laws and regulations,accelerating the promulgation of energy security regulations and formulating specific implementation provisions.Under the guidance of abundant laws and regulations,the strategic energy reserve system,energy risk warning and emergency system and energy consumption system should be constructed.Finally,China is a net importer of energy.Energy security cannot be guaranteed without cooperation with foreign countries.Therefore,it is necessary to carry out multilateral cooperation with countries in East Asia,formulate treaties applicable to East Asian conditions,and improve the dispute settlement mechanism and the common energy reserve system.
