Health is an inevitable requirement for promoting comprehensive human development,and the level of national health determines the quality of a country’s economic development.The right to health,as a human right,has been recognized worldwide.However,the current level of citizen health and economic development in China is not synchronized,so since the 18th National Congress of the Communist Party of China,the construction of a healthy China has embarked on a "fast lane".At present,the national health protection system has been fully formed.Under the goal of national health,sports are an effective way to promote health.However,as sports elites,athletes’ right to health is susceptible to varying degrees of infringement,and phenomena such as unscientific training and physical punishment still exist.Accidents cannot be avoided,which can easily lead to sports injuries,sudden death on the field,depression,and other problems for athletes.There are countless cases of athletes’health rights being violated in reality,but due to the public’s stereotype of athletes’health,this group is actually ignored when implementing the Healthy China Action.Therefore,the health issues of athletes as a vulnerable group should be taken seriously in the implementation of the Healthy China strategy,which is also an important step for China to transform from a sports powerhouse to a sports powerhouse.Law is the key to governing a country,and good law is the prerequisite for good governance.The Healthy China Action also emphasizes the realization of the goal of ensuring the rule of law,so protecting the health rights of athletes should prioritize legislation.At present,the legislative system of athletes’ right to health in China is still not perfect,the legislation is fragmentation,the number is small and the level of effectiveness is low,and there are problems such as poor operability of the legislative content,obvious selectivity of protection objects,etc.The series of issues in the legislative system are not conducive to comprehensive protection of athletes’ right to health.In reality,there are still cases where athletes’ right to health is violated,such as accidental injuries,unscientific training,corporal punishment,etc.,which infringe on athletes’ right to physical health.Improper public opinion intervention and excessive pressure infringe on athletes’ right to mental health.In addition,as a vulnerable group among athletes,special athletes are more susceptible to infringement of their right to health due to factors such as physiological structure and age compared to normal athletes,which urgently requires the attention of legislative bodies.In order to better protect the right to health of athletes,it is necessary to improve the legislative system for the right to health of athletes in China,and formulate a special "Regulations on the Protection of Athlete Health" to increase the protection of athletes’ health rights;Vigorously promoting the post legislative evaluation mechanism to promote the operation of local legislative power;Refine safeguard measures,establish a reasonable vacation system,physical examination system,psychological health counseling mechanism,and improve the sports insurance system to protect athletes’ health rights.The improvement of the legislative system for the right to health of athletes helps to ensure the effective promotion of Chinese athletes’health,assist in the Healthy China Action,and promote the comprehensive,coordinated,and sustainable development of China’s sports industry. |
