| The reform of the national supervision system is a major political reform that is being carried out in China.With the deepening of the reform of the supervision system,the supervisory organs have risen from the subordinate position of the government functional departments in the past to the independent position parallel to the government,courts and procuratorates.The goal of the reform of the supervision system is to establish a supervision system with Chinese characteristics,and ultimately to establish a long-term mechanism of " three non-corruption." Supervision recommendations are an important way for supervisory organs to perform their supervision functions.Focusing on the prevention of corruption,supervision recommendations well echo this goal.This determines that China ’s supervision and suggestion system is to play the role of promoting punishment,taking root in the treatment of symptoms,promoting the construction of a long-term mechanism from dare not to corrupt to cannot corrupt and do not want to corrupt,improving the governance ability of comprehensive system anticorruption and improving China ’s anti-corruption governance system.The functional orientation of supervisory recommendations determines its multi-dimensional legal attributes,that is,for supervisory organs,it is their statutory duty to make supervisory recommendations;for the recommended units,the supervision proposal is a mandatory disposal measure that must be implemented;the supervision suggestion actually plays a’ reputation penalty ’ role in punishing the negative evaluation of the existing problems such as the construction of clean government in the proposed unit,giving it a punitive attribute,but giving the consultation attribute of the rectification suggestion in the supervision suggestion to stimulate the subjective initiative of the proposed unit,actively seek the best practices to achieve the rectification goal,and use this as a legitimate reason not to adopt the ’ rectification suggestion ’ in the supervision suggestion.Based on the above analysis conclusions,this paper identifies the main problems existing in the supervision suggestion system,and puts forward suggestions for improvement one by one.In addition to the introduction,the full text is divided into three parts :The first part analyzes the basic problems of supervision system reform and supervision suggestions.From the narrative perspective,this paper sorts out the target demands of the reform of the supervision system,clarifies the functional orientation of the supervision proposal in the establishment of the supervision system with Chinese characteristics and the construction of the long-term mechanism of " three non-corruption" and endows the supervision with the construction of supervision.The second part identifies the problems of the current supervision recommendation system.Based on the functional orientation and multi-dimensional legal attributes of the supervision suggestion in the construction of the long-term mechanism of " three noncorruption " in the second chapter,the problems existing in the current supervision suggestion system are identified.There are mainly four aspects of practical difficulties and problems : the definition and scope of application of the supervision suggestion is not clear,the implementation procedure is not clear,the format of the proposal is not uniform and the content is not accurate,and the lack of relief mechanism for the proposed unit.The third part puts forward suggestions for optimizing supervision suggestions.In view of the identification of the problems in the third chapter and the analysis of the crux of the problems,specific suggestions are put forward for the above problems,so as to provide some wisdom for the improvement of the supervision suggestion system and the realization of the goal of the supervision system reform. |
