Research On The Legal Regulation Of The Abuse Of Market Dominance By Internet Platform

Internet platform has become an important form of organization in today’s social economic activities,as well as an important component and carrier form of platform economy.With the rapid development of network economy and information technology,people are increasingly engaged in various economic activities on the Internet platform.Internet platforms with strong capital and core technology can usually maintain a leading position in a market for a long time,or even gain a dominant position in the corresponding market.Therefore,in order to maintain their competitive advantage,they may use some unfair means of competition,and abuse of dominant market position is a relatively common means.At this point,the anti-monopoly law enforcement agencies are required to accurately identify whether Internet platform enterprises have market dominance and abuse on the basis of sufficient understanding of the characteristics of Internet platforms and relevant economic law knowledge.The bilateral or multilateral market of Internet platform,network externality,user locking effect and many other features pose many new challenges to antitrust law enforcement.If the Internet market is viewed from a static perspective,the potential competition may be ignored or the innovation that is taking place may be hindered by interference.Taking the case of Qihoo vs.Tencent,which attracted much attention,as the starting point,this paper elaborated the definition of the market related to Internet platforms and the identification of the dominant position of the market.Compared with the influence of the new characteristics of the Internet platform compared with the traditional industry,it suggested that more consideration should be given to the rationality principle when regulating the abuse of the dominant position of the Internet platform,and further improve the relevant legislation.
