Research On The Legal Regulation Of Internet Enterprises’ Abuse Of Market Dominance

In the past ten years,with the rapid development of advanced network technology and mobile terminal equipment,China’s network economy has achieved rapid development,and China’s Internet enterprises have become an important pillar of China’s economic development by virtue of their advanced information technology advantages and market development trend.However,with the development of the network economy,the problem of malicious competition between many enterprises has also appeared in the Internet market,which has damaged the legitimate rights and interests of consumers in transactions and undermined the market order of fair competition.In order to maintain their market dominance in a certain Internet field and obtain high profits,some Internet enterprises hinder the development of their competitors by abusing their dominant market position and disrupt the order of the industry.Moreover,due to the highly dynamic nature of the development of Internet enterprises,China’s current anti-monopoly laws and regulations make it difficult to respond in a timely and effective manner to different new types of abuse of dominant market position in the Internet market.Therefore,this paper attempts to conduct an in-depth study of this issue,which mainly includes four parts,first of all,the relevant theories of Internet enterprises abusing market dominance are explained.Secondly,the current situation of Chinese Internet enterprises abusing their dominant market position is analyzed.Third,the legislative measures to regulate the abuse of market dominance by Internet enterprises outside the territory are analyzed.Finally,suggestions are put forward to strengthen the legal regulation of abuse of market dominance by Chinese Internet enterprises,the main methods are: to clarify the definition of Internet enterprises’ abuse of market dominance;From the aspect of anti-monopoly law enforcement,it is suggested to improve the anti-monopoly law enforcement of Internet enterprises’ abuse of market dominance by cultivating a special anti-monopoly law enforcement team to deal with the abuse of market dominance by Internet enterprises and delegating the enforcement authority of anti-monopoly law enforcement agencies.From the judicial aspect,it is recommended to set up a competition court to specifically hear anti-monopoly cases,and guide relevant anti-monopoly judicial practice through typical cases and judicial interpretations,so as to expand diversified judicial remedies.
