| According to geological exploration data,the Arctic region is rich in oil and natural gas resources,but because it is covered by thick ice all year round,there are not many human operations in this area.In recent years,climate warming has accelerated the rate of melting of Arctic glaciers,and the exploitation of oil and gas resources in the Arctic region has become a hot topic of discussion.China and Russia have carried out in-depth cooperation on the Yamal oilfield project,which has produced good results and accumulated experience for participating in large-scale oil and gas development.However,the complex climatic and geopolitical relations in the Arctic region,the relevant laws and regulations have not formed a complete system,and the Arctic Council,as the most influential government forum organization in the Arctic,has not formally planned resource development matters,which have brought great challenges to China’s development of Arctic oil and gas resources.In 2018,China released the "China’s Arctic Policy" white paper,representing that the Arctic strategy has ushered in a new height,China,as the world’s second largest economy and responsible major country,has the obligation and responsibility to promote the good development of the Arctic order,maintain the Arctic ecological environment,and protect China’s Arctic rights and interests.This paper discusses and analyzes the legal dilemmas and participation paths encountered by China in participating in the development of Arctic oil and gas resources from five parts.The first part describes the research background and ideas,and analyzes and compares the research status at home and abroad.The second part introduces the distribution of oil and gas resources in the Arctic region and the development status at home and abroad,and analyzes the theoretical basis for China’s participation.The third part analyzes the success of the Sino-Russian Yamal oilfield project and the existing legal risks,and provides China’s countermeasures.The fourth part analyzes the legal dilemma faced by China in participating in the Arctic oil and gas resources,and discusses from two levels of international law and domestic law.The international law specifically includes the negative role of the Arctic Council in the Arctic field and the imperfect international legal system in the Arctic region;domestic The legal aspect specifically includes the absence of laws concerning Arctic resources and the absence of an insurance system for foreign investment.The fifth part analyzes the path of China’s participation.As a non-Arctic country,seeking cooperation has always been one of the main ways for China to participate in Arctic affairs,and promote the establishment of a mechanism for cooperative development of Arctic oil and gas resources and a mechanism for conflict resolution to achieve win-win cooperation.At the same time,taking this as an opportunity to promote the improvement of the domestic and foreign investment insurance system,to provide protection for Chinese enterprises participating in the development of Arctic oil and gas resources. |
