Study On The Problems And Countermeasures Of Personal Information Protection In Government Information Disclosure

In the current society,the problem of personal information protection not only involves the horizontal relationship between equal subjects,but also the vertical relationship between individual rights,social rights and state power.With big data,Internet technology development,the government information publicity become with the aid of information data to carry out the government administrative management and the trend of social governance,help to promote the social public democracy,maximizing the value of information data,promote the rule of data under the background of respect and safeguard civil rights,realize social governance work sharing the situation.As the collector,user,disclosure and regulator of information,the government has the obligation to protect the rights and interests of personal information from infringement.However,in the practice of government information disclosure,the phenomenon of infringement of the rights and interests of personal information of citizens frequently occurs.Under the background of recent promulgation of Personal Information Protection Law in China,how to ensure that the rights and interests of personal information in government information disclosure are protected more effectively and systematically,and provide clear legal guidance for citizens’ personal information processing activities,has become an urgent concern.From the perspective of government information disclosure,this paper analyzes the balance between public interest and personal information rights and interests by elaborating the basic theory of personal information protection in government information disclosure,and explores the current practice and legislative status of personal information protection in government information disclosure.This paper reviews the problems existing in legal regulation and judicial practice,such as unclear public interest measurement standards,ambiguous definition of personal information and imperfect information review procedures,and puts forward corresponding suggestions for specific problems,hoping to be beneficial to the protection of citizens’ personal information in government information disclosure.
