Study On The Perfection Of The Legal System Of Horizontal Ecological Compensation In The Whole Yellow River Basin

The legal system of river basin horizontal ecological compensation is a vital legal system innovation in the sustainable development of the whole Yellow River Basin.The study of the whole Yellow River Basin has an important strategic position.The outline of the plan for ecological protection and high-quality development of the Yellow River Basin deliberated and adopted at the meeting of the Political Bureau of the CPC Central Committee in October 2021 stipulates the establishment of a horizontal ecological compensation mechanism for the Yellow River Basin.In this context,the paper hopes to help the new pattern of "great protection and governance" of the whole Yellow River Basin through research.This paper mainly adopts normative legal methods,empirical analysis methods and comparative research methods.Firstly,it combs and compares the current situation of the construction and implementation of the legal system of horizontal ecological compensation in the whole Yellow River Basin,analyzes the representative horizontal compensation in Henan Shandong section of the Yellow River,Xin’an River and Chishui River,and expounds the difficulties faced by the horizontal ecological compensation in the whole Yellow River Basin from two aspects of legal norms and legal implementation.On the one hand,it is mainly manifested in legal norms,the lack of ideological awareness of ecological civilization,the lack of horizontal ecological compensation measures for the entire Yellow River Basin,the great differences in the provisions of the interests and protection effects of each province,the upper and lower reaches and the left and right banks of the legal provisions of mutual constraints.On the other hand,the implementation of the law,the lack of integration of relevant policies,the whole basin of the Horizontal Ecological Compensation Accounting System is not reasonable,the Yellow River basin of the horizontal ecological compensation way is single,lack of support of the security system.On the premise that the existing law does not clearly define the specific content of the Horizontal Ecological Compensation Mechanism for the whole Yellow River Basin,and lacks the overall horizontal ecological compensation provisions for the whole River Basin,this article proposed that should carry on the consummation through the legal norm and the law implementation two aspects.We should not only strengthen the thought of ecological civilization,establish the relevant regulations of the horizontal ecological compensation in the whole Yellow River Basin,make clear the compensation subject and the compensated subject,make clear the size of responsibility and the allocation of compensation funds.On the flip side,it is necessary to establish the mechanism of Horizontal Ecological Compensation Work Platform and perfect the system of horizontal ecological compensation accounting in the whole Yellow River basin,the horizontal ecological compensation modes of the whole Yellow River basin should be diversified to strengthen the guarantee support of the horizontal ecological compensation of the whole Yellow River Basin.The high-quality development of the Yellow River is an important component of the construction of ecological civilization in our country,the interests of ecological and environmental protection will be promoted in an all-round way in all provinces and regions along the whole Yellow River Basin.
