Since the reform and opening up,the industrialization and urbanization of the Yellow River Basin have accelerated,and the discharge of industrial sewage and domestic sewage has increased significantly.However,the Yellow River Basin is short of natural water resources,the water environment is fragile,and the problem of water pollution is becoming more and more serious.In recent years,the Yellow River Basin has gradually paid attention to water pollution control.The state also takes the ecological protection of the Yellow River Basin as a national strategy and vigorously promotes the comprehensive management of the basin.In recent years,the Yellow River Basin has carried out a variety of collaborative governance models,including the joint action working group,and achieved certain results.For example,China Ecological Environment Bulletin in 2019 shows that the water quality of the Yellow River Basin has been significantly improved,and the water quality of the Yellow River Basin has changed from mild pollution to good in 2020.At present,only a small number of grade 5 water quality is poor.Water pollution control in the Yellow River Basin is generally in good condition,but there are still many problems.For example,in practice,the coordination between various government departments is ignored,resulting in low processing efficiency.Water pollution control in the Yellow River Basin is an extremely complex process.Control should not be limited to afterwards,but should include prevention and control in advance.Therefore,the problem of water pollution can not be solved by the efforts of one department alone.Only the cooperation of multiple departments can more effectively control the water pollution in the Yellow River Basin.This article uses literature analysis,comparative analysis and other methods to examine the cross-departmental coordinated governance of the Yellow River water pollution area from the perspective of environmental rule of law.It believes that the basic legal reason is the imperfect legal system.The cross-departmental coordination mechanism can fundamentally improve the efficiency of water pollution control in the Yellow River Basin.This article believes that government departments,as the main force in the treatment of water pollution in the Yellow River Basin,are defined as rational economic persons,but each department deliberately or unintentionally measures the impact of behavior on the interests of the department when performing specific administrative actions.The government departments of rational economic people cannot escape departmentalism,so they must use the rule of law to realize the transformation of water pollution in the Yellow River Basin from separate management of various departments to cross-sectoral coordinated management.This article focuses on discussing the cooperative relationship between various government departments in the Yellow River Basin from the perspective of legal system construction.Starting from the current situation of water pollution control in the river basin,it is concluded that the basic reason for the difficulty in implementing cross-departmental coordinated governance of water pollution is that the law does not clearly define cross-departmental coordination.The legal status of various departments is not clear,and there is a lack of due supervision and accountability mechanisms.In order to solve the above problems and improve the legal system for cross-departmental coordinated governance of water pollution in the Yellow River Basin,this article refers to the experience of typical foreign river basin water pollution governance and cross-departmental coordinated governance experience,combined with the actual situation of the Yellow River Basin,and proposes targeted improvements.Suggest.Because sound legislation is the basis for the operation of the system,we should first improve the relevant legislation for the cross-departmental coordination of water pollution in the Yellow River Basin,clarify the legal status of cross-departmental coordination,and further institutionalize the existing random and spontaneous cross-departmental coordination and cooperation model.On this basis,it is necessary to improve the relevant systems for cross-departmental coordination of water pollution,clarify the division of duties and powers of each department,and improve the benefit compensation mechanism to coordinate the interest relationship between the various departments,as well as the supervision of the internal permanent coordination agency and the supervision of the external public.Finally,unify the governance objectives of the governance entities,establish a normalized cross-departmental coordination organization,and add the governance results to the cadre evaluation and assessment system to improve the synergy of various departments in practice and promote cross-departmental coordination among various departments. |
