Research On Consumers’ Rights Protection In Overseas Purchasing

In recent years,with the significant improvement of the overall consumption level of domestic consumers,domestic goods have been increasingly unable to meet consumers’ demand for high-quality products,and many consumers have turned their attention to overseas consumer markets.In this case,overseas purchasing,a convenient consumer shopping mode,has gradually become a popular shopping mode for consumers.However,in this process,many problems have gradually arisen from overseas purchasing,and at the same time,various lawsuits caused by such contradictions have increased year by year.Although the relevant departments are constantly improving the relevant laws and regulations,it is still difficult to fundamentally eliminate all kinds of chaos in overseas purchasing.This paper hopes that through the research on the protection of consumers’ rights and interests in overseas purchasing,it will provide protection for consumers’ rights and interests,and then promote the healthy development of overseas purchasing.This paper is divided into five parts.The first part is the introduction,combining with the research background of overseas purchasing,discussing the research status,comparing the research at home and abroad,and drawing lessons from the legal contents worthy of study,so as to lay a theoretical foundation for my thesis.The second part is an overview of the thesis,which mainly defines the basic legal concepts in overseas purchasing,studies the legal relationships among the subjects in overseas purchasing,and summarizes the significance of protecting consumers’ rights and interests in overseas purchasing.The third part analyzes the problems and reasons of the protection of consumers’ rights and interests in overseas purchasing: consumers’ basic rights such as the right to know,the right to fair trade,and the right to claim are easily violated,and various reasons such as information asymmetry,abuse of format clauses,and unclear division of rights and responsibilities in the purchasing process make it difficult for consumers’ rights and interests to be effectively protected.The fourth part and the fifth part mainly draw lessons from the overseas regulations on the protection of consumers’ rights and interests in overseas purchasing,and then inspire our country to carry out corresponding protection of consumers’ rights and interests in overseas purchasing,so as to put forward corresponding suggestions to improve our country’s protection of consumers’ rights and interests in overseas purchasing.The innovation of this paper lies in the specific analysis and comparison of the legal relationships among the subjects in overseas purchasing,focusing on the specific manifestations and reasons of the infringement of consumers’ rights and interests in overseas purchasing,drawing lessons from foreign laws,and making targeted suggestions.The author hopes to protect consumers’ basic rights from the system,provide consumers with more ways to resolve disputes,establish and improve a more complete trading system,and improve relevant laws and regulations,so as to finally promote the sustainable development of overseas purchasing industry.
