Research On The Construction Of China’s Skilled Migration Legal System Under The Background Of The 14th Five-Year Plan

In today’s world,with the vigorous development of the new technological revolution,the international talent competition is becoming increasingly fierce.The process of economic globalization further accelerates the flow of human resources in the global market.Countries all over the world are competing for high-tech talents through various means.China has long been a major exporter of immigrants,in recent years,with the economic and social development and the gradual liberalization of restrictions on the flow of immigrants,a large number of senior technical talents have gone abroad to study and work and obtained permanent resident or citizenship in the host country.At the same time,the scale of China’s introduction of overseas senior technical talents has always been very small,the ratio of talent introduction to talent output is seriously unbalanced,and there is an adverse situation of "net outflow" of talents in China.In order to reverse this situation,since the reform and opening up,China has successively issued a series of legal and policy documents aimed at attracting overseas talents.However,due to many factors,such as incomplete system,unreasonable content and weak social foundation,the scale and efficiency of introducing overseas skilled immigrants still do not match the level of economic and social development.Since the 18 th CPC National Congress,the party and the state have attached great importance to strengthening the introduction of overseas talents.The 14 th five-year plan for national economic and social development and the outline of long-term objectives for 2035(hereinafter referred to as the 14 th five-year plan)issued in 2021 put forward the strategic concept of exploring the establishment of a skilled migration system from the perspective of national economic and social development,It fully demonstrates China’s determination to seize the opportunity of the times and vigorously strengthen the introduction of overseas talents.From a worldwide perspective,it is a general trend to adjust skilled migration affairs through the establishment of complete legal norms.At the same time,carrying out legislative reform in the field of migration,clarifying legal relations and making up for legal shortcomings is also an inevitable requirement for China to comprehensively promote the rule of law and build a socialist country under the rule of law.Therefore,in addition to combing and integrating the existing legal system,we should also critically absorb the advanced ideas and useful experience of developed immigrant countries in combination with China’s national conditions and world migration trends,explore and establish a skilled migration legal system with Chinese characteristics,and provide a solid legal guarantee for China’s overseas talent introduction.Based on this understanding,this paper attempts to analyze the current situation of China’s skilled migration legal system,select representative immigrant countries as the research object,summarize and refine the experience that can be used for reference,and put forward some ideas and suggestions on the construction of China’s skilled migration legal system.
