On Multiple Settlement Mechanisms For Territorial Disputes

Territorial disputes are the object of study of public international law,a universal phenomenon in the world and one of the important factors giving rise to international conflicts.There are not only territorial disputes left over from history and continuing to the present,but also territorial disputes arising in order to compete for economic and strategic resources in the context of the new era,which,if not handled well,are likely to lead to armed and war conflicts.In the international community,territorial disputes will become "thermometers" to measure the degree of contradiction between the two countries,to vent dissatisfaction and hostility to the other country and to exert pressure on the disputing countries.In recent years,many hot issues in the international community are related to territorial disputes,in 2021,the territorial dispute between Japan and Russia on the four northern islands has once again become a hot topic,on January 12,2022,China and India held the 14th military commander-level meeting on the Sino-Indian border dispute,and a series of topics on territorial disputes in the international community show that territorial disputes are enduring,but whether it is from the perspective of the internal laws of individual countries or the entire international law,the legislation on territorial disputes is not perfect.Therefore,the topic of territory has important research value in any era,and the peaceful settlement of territorial disputes between countries is also an important issue facing international law.This paper enumerates and analyzes the current settlement mechanism of territorial disputes,and this article is divided into four parts,the first part is the current situation of international territorial disputes,briefly explaining the causes of territorial disputes,treaties on the settlement of international territorial disputes,the distribution area of international territorial disputes and the types of territorial disputes;the second part mainly states the mechanisms currently used in the international community to resolve territorial disputes:legal settlement mechanisms,political settlement mechanisms,and regional organization settlement mechanisms The third part summarizes the new thinking and new ways of settling territorial disputes that exist in the international community today,the fourth part puts forward several rationalization opinions on the dilemma of the current territorial dispute settlement mechanism,with a view to improving and developing the territorial dispute settlement mechanism.When dealing with territorial disputes,territorial disputes should be analyzed on a case-by-case basis and in a variety of ways,in a creative and peaceful manner.
