Shanghai International Settlement Mixed Court Of Justice Justice System

Shanghai International Mixed Court is a special tribunal in the history of Shanghai International Settlement. It was not only a branch of justice agencies that Chinese local government accredited to concessions, but also a mixed tribunal. From 1864 to 1927, International Mixed Court experienced the transition from traditional society to modern society in China, mixing the elements of western laws in traditional justice system, which exerted influence on every aspect of the municipal administration and economic life in the Settlement. This article will focus on Shanghai International Mixed Court that is carried out in two ways: On one hand, introduce the background, development, withdrawal and reorganization of International Mixed Court from static point of view by investigating historical data so that people can master International Mixed Court comprehensively. On the other hand, analysis operational procedures of judging cases and the evolution of justice system in International Mixed Court from moving point of view by investigating laws.This article is divided into three chapters. Chapter One: the historical changes in International Mixed Court in the Settlement. I will restore the background, development, withdrawal and reorganization of International Mixed Court. Chapter Two: the trial system of International Mixed Court in the Settlement. On one hand, I will investigate the organization and operation of International Mixed Court under various authorities in a macroscopic way; on the other hand, I will investigate the trial system of International Mixed Court in the Settlement through a number of specific cases that were investigated, transferred, prosecuted, judged and executed. In order to make people fully understand the changes in the trial system in different periods, this chapter will expound the predecessor of International Mixed Court, that before and after Revolution of 1911 respectively. Chapter Three: conflict and integration of Chinese and Western justice system. As a tribunal mixing Chinese and Western elements, International Mixed Court provided the platform of conflict and integration for two different justice systems. It formed a set of justice system with characteristics of International Mixed Court after being constantly integrated, assimilated and optimized on the basis of historical traditions.
