Research On Personal Information Protection Under The Normalization Of Epidemic Prevention And Control

Since the outbreak of New Coronavirus pneumonia in Wuhan in December 2019,personal information collection,management and utilization have been carried out throughout the epidemic prevention and control work.Due to covid-19 outbreak of sudden outbreak of new crown pneumonia and the urgency of prevention and control of epidemic situation,many personal information processing activities have not been examined in substance.With the development of the epidemic entering the normalization stage,state organs and Internet big data enterprises have increasingly frequent processing activities for citizens’ personal information,and many subsequent problems have gradually surfaced,such as the inconsistency in the definition and judgment criteria of personal information in China’s civil code and personal information protection law,the restriction of state administrative power on citizens’ personal information rights and interests,the lack of autonomy norms of the Internet industry,citizens’ awareness of personal information security is insufficient.These problems not only make citizens’ personal information security have many risks,but also seriously endanger citizens’ personal information rights and interests.Therefore,during the epidemic prevention and control period,when ensuring the efficient and orderly progress of epidemic prevention,the problem of how to strengthen the protection of citizens’ personal information needs to be solved urgently.Based on this,based on the special period of normalization of epidemic prevention and control,this paper focuses on solving the problems existing in China’s practice,and seeks the balance between epidemic prevention and public interests and citizens’ personal information rights and interests.Even the epidemic prevention work out of major public interests should not be at the expense of excluding citizens’ personal information rights and interests.It still needs to follow the principle of proportion,the principle of minimum necessity and the principle of informed consent.We should not only ensure the efficient progress of epidemic prevention,but also fully protect citizens’ personal information rights and interests from infringement.Finally,starting from the many challenges faced by personal information protection during the epidemic prevention and control,this paper puts forward solutions such as clarifying the legal connotation of personal information,effectively maintaining the basic principles of personal information protection,and improving the autonomy norms of data application industry,so as to strive for the orderly progress of epidemic prevention under the framework of legal system,give citizens a sense of security during the epidemic prevention and control,and ensure that citizens’ personal information rights will not become meaningless.
