Unemployment has always been a long-term social problem in China.In recent years,due to outbreak of the epidemic,the international situation is unstable,the global economic depth recession,China’s unemployment has skyrocketed year-on-year.The insurance system has a very important role in maintaining the basic livelihood of the unemployed population.During the long-term operation of China’s social security system,the role of unemployment insurance is not significant compared to other four insurance systems.The reason for this phenomenon is that the current "Unemployment Insurance Regulations" have been running for more than 20 years,and the society has had a lot of earth-shaking changes,some of which can not meet the needs of modern unemployed people.The Ministry of Human Resources and Social Security issued the "Unemployment Insurance Regulations(Draft)",which has been revised by many of the previous academic and practical issues,but the content of the modification is not actually introduced and implemented.With the continuous development of the social economy,the new problem is endless.Especially since the 2019 "COVID-19" broke out,the "Unemployment Insurance Regulations" has been more urgent.The first chapter discusses the two typical cases,discovering the scope of labor compensation in the unemployment insurance system and the "unwillingness to interrupt employment" in judicial practice,although it satisfies the "post-proof certificate" The form of conditions,but it is essentially difficult to define.The second chapter mainly combed the basic theory of unemployment insurance,mainly including the meaning,function and the development of the unemployment insurance system.The third chapter explains the three problems in the current unemployment insurance legal system in my country.First,the scope of labor compensation has not been clearly stipulated.The second is that "non-because of my will" stipulates that the workers who have emerged in today’s society have not covered the health of the society,support the elderly.Reasons for raising children,policies,etc.,the third is that my country’s current unemployment insurance system lacks the terms that responds to major public health emergencies,Stable policy into the system and flexible employees lack institutional guarantee.The fourth chapter puts forward the above problems,including clarifying the scope of labor compensation,emphasizing that the laborer ’s integrity obligations to terminate the contract of the labor relations,explaining the "non-voluntary interruption employment",joining "justified reason",will "stabilize " Incorporate the unemployment insurance regulations,promote the re-employment function of unemployment insurance,and provide institutional protection for flexible employees.In the face of increasingly complex international domestic situations and increasingly serious unemployment issues,my country’s current unemployment insurance legal system urgently needs to be improved and revised to promote social stability,promote economic transformation and development.
