Research On The System Of Protection Of The Rights Of Abused Children From The Perspective Of The Family

Today,in the context of economic and social rapid development and the continuous improvement of the material conditions of the population,family problems arising from various causes are becoming more prominent and attracting widespread attention.As the number of children increases and their share of the total population increases,the importance of protecting the rights of the child becomes more and more prominent.As a vulnerable group,children are more vulnerable to violations of their rights due to their own vulnerability and difficulties in obtaining timely redress.The problem of domestic violence against children has risen from a problem within the family to one that must be addressed in order to preserve social harmony and guarantee fundamental human rights.However,due to the influence of traditional cultural concepts,the lack of systematic legal provisions and the lack of operational aspects of some systems for the effective protection of children’s rights and interests,it is difficult for the current legal system to protect children’s rights and interests in a comprehensive,systematic and integrated manner,and the problem of violations of children’s rights and interests remains serious.In addition to the conclusion,there are four chapters in this thesis.In the first chapter,the author takes two typical cases of child abuse in the family as the starting point,puts forward the problem of child abuse in the family,analyzes the background and significance of child rights protection research and the present situation of child rights protection research at home and abroad,and clarifies the scope and methods of the research.In the second chapter,an overview of the protection of the rights of abused children from a family perspective,a definition of child abuse,a detailed description of the characteristics of child abuse,the serious physical and psychological harm caused to children by abuse,the basic principles of child rights protection,and the main elements.In the third chapter,the current legislative status of children’s rights protection at home and abroad,this chapter is divided into two subsections,the first subsection analyzes the current legislative status in China from the perspective of laws such as the Law Against Domestic Violence and the Law on the Protection of Minors,the second subsection discusses the shortcomings of legal provisions under the current legislative status.In the fourth chapter,mainly from several perspectives,such as strengthening legislation related to child rights protection,improving the mandatory reporting system,establishing an integrated child rights protection system of family,state and society,and improving the habeas corpus system,offers personal prospective suggestions for the improvement of the system related to the protection of children who are abused in the family environment.
