Abstract/Summary:
The situation of children is related to the future of the country.The family is important for children’s survival,so it is imperative to protect children from the invasion from the family.China’s laws have great deficiencies in protecting the children who suffer from domestic violence.As a faithful practitioner of the principle of children’s best interests,Britain’s legal value,legislative ideas and specific countermeasures can provide beneficial thinking for China.Using the comparative analysis method,this paper introduces the law of protecting children in the UK,and analyzes the value orientation,legislative and practical ideas and specific measures of protecting children in domestic violence.In terms of legal concept,it mainly introduces the origin,evolution,connotation and benchmark of the principle of children’s best interests and the concept of children’s rights standard.In terms of legislation,it mainly summarizes the scope of domestic violence,children and family abuse;in terms of justice and practice,it mainly combs and analyzes the police intervention,court protection,local authorities’ actions and social organizations’ efforts in the protection of domestic violence children in Britain.On this basis,this paper makes a reasonable analysis and evaluation of the legal path to prevent and control children’s domestic violence in Britain,and discusses its effectiveness and shortcomings,as well as its operation experience and exposed problems.In the end,we can see the deficiency of the protection system for the rights of children in our country,and draw the Enlightenment of expanding the scope of domestic violence for children,combining early intervention with post repair,balancing children’s safety interests and contact needs,and promoting multi sectoral linkage and establishing an integrated anti domestic violence network.
