In recent years,cases of child abuse occur frequently,which cause widespread concern ofthe community,people began to re-examine our country’s legal system to protect children’srights and the social security system.Since our country has proposed the idea the rule oflaw,the number of the legal provisions are growing follow with it,and maturing day byday.but deletions and gaps still exist,especially in the areas of child abuse laws.China’scurrent provisions to prevent child abuse only scattered Constitution, Civil Law,CriminalLaw,Law on the Protection of Minors, marriage and other legal provisions,the provisions ofthese laws is not only too vague but also lacking of specific details of disciplinarymeasures;The same time,the serious lack of public moral beliefs,and weak of regulatorysupervision family and society, the marginalization of the role of government and soon,these defects make that there are no laws to follow to solve child abuse, no rules tofollow,and no protection at all, so that these cases can not be properly solution, the legitimaterights and interests of children can not protected effectively.To solve this problem, this article based on the existing legal and social status quo ofchina, analyze the causes, and learn from some advanced foreign legislation and socialsecurity measures, to propose legislative, judicial, administrative, social protection, and otheraspects of regulatory supervision, hoping to comprehensive a multi-level prevention systemto construct a whole society which all people participate in, giving back the children a trulysafe, happy and bright childhood, to mack the community has more childish smile.
