| NFT,technology application and industrial development has brought unprecedented application scenarios and application experience,opened a digital goods,industry,digital copyright,digital governance of new digital era,but there’s no denying its brings the challenge and risk is also unprecedented,corresponding legal system and regulation is not yet perfect.From 2021,digital music NFT cases continue to emerge.Digital music NFT is still in its infancy.The emergence of NFT provides a new sales pattern for music products and generates a new source of income.However,it also inevitably causes some legal risks.Many buyers and bidders do not know what they are buying,and the protection of consumer rights and interests faces great challenges.NFT’s secondary transactions,speculation will also bring huge financial risks.In this paper,by analyzing the present stage NFT products are faced with the problem,and the difficulty of legal protection,and combing the digital music NFT cases related to the product form,legal theory,the existing of digital music NFT involved in related legal problems in depth analysis,inductive NFT product characteristics,further analysis of digital music NFT product legal attribute,and the related regulation.Therefore,it puts forward constructive suggestions on the legal regulation and administrative supervision of digital music NFT.Combined with the domestic and foreign NFT technology application and legal regulation experience,form a system of digital music NFT legal risk analysis system.For digital music NFT products are released,should from the legal system building,protection of the rights and interests of consumers,the Internet platform,the perspective of the financial system regulation and so on legal regulation,at the same time shall be disciplined by the NFT platform and combined with the profession autonomy,giving play to the role of industry associations and value,for the healthy and orderly development of NFT products to lay a good foundation.Form guidelines for legal regulation,supervision and compliance of digital music NFT,and organically combine theoretical research with practical value. |
