A Study On The Mode Of “Dispatch And Itinerant” Procuratorial Supervision In Prisons

The law gives the procuratorate the power to supervise the prison’s penalty execution activities.The Supreme People’s Procuratorate began to pilot a new "stationed + itinerant" procuratorial supervision model in 2018,and achieved results in the pilot.Among the increasingly perfect legal provisions,a series of legal documents such as the prison law,the organic law of the people’s Procuratorate and the measures for prison procuratorial work have detailed legal provisions on the "stationed + itinerant" procuratorial supervision model,In the process of supervision,how to apply the law and how to apply the law scientifically determine the final quality and effect of supervision.In judicial practice,based on the new procuratorial supervision mode,the procuratorial organ has gradually found many deeper problems in the prison,and the number and quality effect of handling specific cases have gradually increased.However,various illegal cases in the prison have been banned repeatedly,which has seriously affected the transformation of prisoners and social fairness and justice.In view of this,we must improve the design of the new procuratorial supervision system,from the source to the specific details,fill the legal loopholes,strengthen legal responsibility and optimize the system model.The full text of this paper is divided into four parts: the definition,theoretical basis,research report in the implementation process(Taking Jinan City,Shandong Province as an example),existing problems and improvement scheme of "dispatch + tour" procuratorial supervision.Through these four parts,starting from the dimensions of finding problems,analyzing problems and solving problems,we strive to improve the new procuratorial supervision mode and improve the quality and efficiency of prison procuratorial supervision.Specifically,this paper is divided into four parts:The first part mainly defines the concept,development history and role of post,tour and "post + tour" new procuratorial supervision.It explains the theoretical basis of the new procuratorial supervision mode and proves the theoretical support behind its perfect development.The second part analyzes and compares the data of prison supervision activities,the number of penalty changes and the living environment of prisoners in J city of S Province since the implementation of the "stationed + itinerant" procuratorial supervision system in 2018,and obtains the current stage of the perfection of the "stationed + itinerant" procuratorial supervision system and the problems found in the implementation process.The third part aims at the current situation of J City in S Province,and analyzes the difficulties and problems faced by the "post + tour" procuratorial supervision mode in terms of legal system,implementation process and personnel allocation from the perspective of the whole top-level design.The fourth part puts forward countermeasures and suggestions from six aspects: improving the law,formulating a unified criminal execution law,improving the coercive means of prison procuratorial supervision,deeply promoting the procuratorial supervision of inter provincial itinerant prisons,improving the follow-up procuratorial supervision system,establishing a talent pool and paying attention to the application of big data in prison procuratorial supervision.
