Research On The Reform Of China’s Prison Circuit Procuratorial System

Prison prosecution is an important legal supervision function given by the law to the procuratorial organ,and it is an important part of the supervision of criminal proceedings in our country.The prison procuratorial system came into being with the emergence of procuratorial organs,and it mainly experienced four historical development stages.Prison procuratorial modes are mainly summarized into three types: the traditional mode of stationed procuratorial mode,the circuit procuratorial mode,and the "stationed + circuit" mode.The reform of the prison circuit procuratorial system is a major innovation of the way of prison procuratorial supervision and is the self-development and perfection of the socialist procuratorial system with Chinese characteristics.In May 2018,the Supreme People’s Procuratorate launched a trial of prison circuit procuratorial work across the country,and in July 2019,the work of prison circuit procuratorial was launched nationwide.Since carrying out the reform of prison circuit procuratorial work,Hebei province has strengthened the system construction and formed a set of relatively complete rules and standards of circuit procuratorial work.Hebei Province,on the basis of adhering to the routine and mobile circuit procuratorial,adopts the cross-regional circuit procuratorial and special circuit procuratorial,gives full play to the advantages of the circuit inspection system,has achieved remarkable results,and effectively verified the value and function of this system innovation.With the deepening of the reform,some problems and deficiencies appear.There are still some deep-seated problems and institutional obstacles in practice,such as prison procuratorial supervision quality effect remains to be further improved,the effective combination path of prison circuit procuratorial work and stationed procuratorial work is not clear,the combination of prison circuit procuratorial work and criminal execution change supervision is not close enough,the coordination mechanism of the prison circuit procuratorial work needs to be further improved,and the application of information method in the prison circuit procuratorial work is insufficient.Due to the problems in prison circuit procuratorial system,we should refine the prison circuit procuratorial system,clear the path of combination of stationed procuratorial mode and the circuit procuratorial mode,constructing the synchronous circuit procuratorial supervision procedure for the criminal execution change,improve the coordination mechanism of the prison circuit procuratorial work,enhance the information level,to further perfect the prison circuit procuratorial system and deepen the reform path of the prison circuit procuratorial system.
