Research On The Governance Of Complaint And Proposal Related To County Land Expropriation And Demolition

In recent years,China’s economy has developed rapidly,the industrial structure has undergone profound changes,and the urban construction has changed with each passing day,resulting in a series of new social contradictions and petition problems.According to the survey,at this stage,the problems of urban and rural construction in the acceptance of complains and proposal in China are increasing year by year.Among them,the problems of land acquisition and demolition,resettlement compensation and shantytowns reconstruction account for a large proportion,which has increasingly become one of the main sources of complains and proposal.It is more common throughout the country,especially in areas with high economic development level and rapid urban construction process.The issue of complains and proposal for expropriation and demolition is directly related to the vital interests of the masses and social stability and harmony.It has aroused widespread concern of the masses and society.It is a more sensitive social issue and an important aspect of grass-roots social governance.Taking J District of Shandong Province as an example,using the theory of social conflict and public governance,this thesis analyzes the complaint and proposal data and typical cases of expropriation and demolition in this area from 2011 to 2020.In terms of social conflict theory,the complaint and proposal system,as a safety valve of social conflict,has played a positive role in maintaining society.Public governance theory is a new governance theory,which advocates actively cultivating multiple governance subjects outside the government,so as to optimize the social governance structure and improve the efficiency of social governance.The study found that the total amount of complaint and proposal for expropriation and demolition in area J increased first,then decreased,and finally stabilized.There are many cross level visits,individual visits,repeated visits and abnormal visits in this kind of complaint and proposal.This kind of complaint and proposal has multiple demands,multiple subjects and various forms,which has the characteristics of times,abnormity and individuality.There are many kinds of classification basis for complaint and proposal of expropriation and demolition,This paper focuses on the classification methods based on the demands of complaint and proposal.According to the demands of complaint and proposal,it is divided into resettlement compensation,expropriation and demolition policy,housing demolition and other four categories and the implementation of compensation,personnel definition and other 14 categories.Through the analysis of typical cases and the actual demands of petitioners,this thesis introduces various types of complaints and proposals in detail.At present,J district has established complaint and proposal governance mechanisms such as complaint and proposal joint meeting and complaint and proposal hearing,and has made some achievements in resolving the contradictions and disputes of complaint and proposal in expropriation and demolition.However,under the conflict of expropriation and demolition,grass-roots social governance still faces difficulties,such as light power and heavy responsibility of complaint and proposal departments,imperfect complaint and proposal assessment mechanism,a large number of complaint and proposal not real end and the unimpeded way of right relief,which brings great challenges to grass-roots social governance.From the aspects of legal policy,government performance and social governance,the author finds that unreasonable resettlement compensation policy,imperfect laws and regulations,incomplete separation of complaints and visits,and deviation of government governance concept are all important reasons for the frequent occurrence and high total number of the complaint and proposal for expropriation and demolition in J District.According to the theory of public governance,it is necessary to improve the current situation of complaint and proposal of grass-roots expropriation and demolition by promoting the legal construction of expropriation and demolition,improving the governance body of complaint and proposal,and optimizing the governance mechanism of complaint and proposal,so as to promote the resolution of contradictions in expropriation and demolition,and realize the stable development of society and long-term stability.
