Optimization Research Treatments Minors Special Education System In China

To take preventive measures against the behavior of minors which has social harmfulness,violates the criminal law and is punished by penalty,not only includes some specific behaviors stipulated in the criminal law,but also includes two kinds of nonstandard behaviors with hidden and exposed hazards,namely ’bad behavior’ and’serious bad behavior’ deeper than the former.China has adopted a policy of’education-oriented and careful criminal punishment’ in dealing with juvenile delinquency.Under this premise,in order to prevent juvenile delinquency and correct juveniles,China has successively implemented correctional systems such as labor education system,work-study education,and government acceptance and education,and has finally been replaced by special correctional education system for juveniles because it does not meet the needs of the development of the times.It is of great practical significance to study the optimization of special correction education system for minors in China.Reviewing the changing process of China’s juvenile correction system,there is a historical cognition of China’s past correction system.On this basis,this paper puts forward and introduces the latest correction system ’special correction education system for minors’ in China,and thoroughly analyzes the state-of-art and problems of special correction education system for minors.In terms of the system,the legislation of specialized correction education system for minors is single,the definition of specialized schools is vague,the scope of enrollment is not clear,the legitimacy of the enrollment process is doubtful,and the relevant conceptual procedures are unclear.The legitimate rights and interests of minors are not fully protected,and the responsibilities of the relevant guardians are not clear.There are operational difficulties in implementation.It is difficult to fulfill the responsibilities of the Specialized Education Steering Committee.The establishment and management of special schools also need to be carefully considered,as well as insufficient connection between corrective measures and existing legal sanctions.By means of the comparative research of corresponding theories and redemption in Japan,Chinese Taiwan and Chinese Hong Kong,it is necessary to ensure the effectiveness of corrective education measures,improve legislation and implement scientific implementation rules of corrective measures in juvenile education.In view of the problems,we should start from two aspects of improving the system content and implementation to solve the optimization of the education system for special correction of minors.In terms of the content of the system,the prevention and correction system of juvenile delinquency should be constructed through legislation,the relevant provisions of specialized schools should be clarified,the protection of the legitimate rights and interests of minors should be strengthened,and a special guardian support system should be constructed;In the implementation,improve the management mechanism,standardize the construction and management of specialized schools,improve the corresponding follow-up counseling mechanism.
