Research On The Legal Regulation Of School Bullying In China

The treatment of school bullying is directly related to the happiness and sense of security of students and parents.Minors are the future of our country.How to regulate the minors who bully in school is a major issue facing the governance of school bullying in China.The author starts with the concept of school bullying,uses literature analysis,empirical research and other methods to sort out and analyze the current situation of school bullying in China,and sort out the current laws to regulate school bullying in China.Finally,the author puts forward his own suggestions on the legal regulation of school bullying in China.At present,China’s civil law,law on penalties for public security administration,criminal law and laws specifically aimed at minors have the content of regulating campus,but there are more or less problems,which is not conducive to fundamentally solve the problem of school bullying in China.For minors especially young minors implementation of bullying and other illegal and criminal behavior,our country should uphold the policy of "education,persuasion and save" and the principle of "curing,cure patents" to regulate this part of the lost sheep "," in the school,family and society,with the help of its existing problems,in turn,turn over a new leaf and final reintegration into society should be our ultimate goal.To be specific,this paper holds that in the aspect of civil law,we can introduce the system of habeas corpus in the Anti-Domestic Violence Law to achieve the effect of "stopping the infringement".In the aspect of administrative law,the principle of "cure the early and cure the young" can be adopted to reasonably reduce the age of administrative responsibility,so that the minor crimes can be timely and effectively regulated to avoid "troubling spells".In terms of criminal law,the author believes that juvenile bullies should be included in special education and other protective measures,and it may be a better choice to correct their vices through special education.In addition,community correction for qualified bullies and the optimization of community correction measures to correct their behavior habits are also desirable measures.In terms of the laws specifically aimed at minors,it is necessary to further determine the specific implementation mode and correction period of specialized education.To sum up,only through the joint efforts of civil law,criminal law,administrative law and laws specifically for minors and flexible measures at all levels,can we finally achieve the goal of effective regulation of school bullying and provide students with a happy land for learning and growth.
