A Study Of Construction Of A Third-Public Legal Service Evaluation System

This paper takes third-party evaluation mechanism of public legal service as the research object,including five parts.The first part is an overview of the third-party evaluation mechanism of public legal service.According to the official definition and concept of public service and third-party evaluation,the author redefines the definition of the third-party evaluation of public legal services and analyzes its three advantages,namely independence,specialization and authority.At the same time,the author proposes that the construction of the third-party evaluation mechanism of public legal service should base on socialist legal system,management related theories,14th Five Year Plan,and the requirements of the Ministry of Justice on promoting the construction of public legal service system.The second part analyzes the significance of constructing the third-party evaluation mechanism of public legal service.The author comprehensively expounds the significance of its construction from both macro level and micro level.The author summarizes five values at a macro level and three values at a micro level.The third part introduces the current situation of evaluation mechanism of public legal service,including four sections.The first two sections introduce and analyze evaluation mechanism of public legal service from the point of view of regions and types respectively.The third section introduces four foreign legal service evaluation mechanisms that are of great reference value for the development of Chinese third-party evaluation mechanism of public legal service.The fourth section focuses on the problems existed in the construction of thirdparty evaluation mechanism of public legal service.Through the four sections,the author conducts a relatively systematic analysis of the current situation of Chinese public legal service evaluation mechanism,and finds out a direction of constructing Chinese third-party evaluation mechanism of public legal service.The fourth part is the kernel of the paper.The author creatively proposes a new theoretical model---public opinion survey+think tank experts evaluation.Focused on the public opinion survey model and think tank experts evaluation model,the author elaborates its operation rules and procedures,showing its characteristics and advantages of simple operation,smooth and standardized process,scientific results and high authority.At the end of the paper,the author proposes five paths for the construction of a third-party evaluation mechanism of public legal service:First,promote the diversification of third-party evaluation subjects and evaluation objects through formulating legislation and regulation;Second,establish appropriate standard of third-party evaluation mechanism of public legal service;Third,enhance the application of evaluation methods and strengthen the regulation of evaluation objects;Fourth,design a scientific and easy-to-operate third-party evaluation model of public legal service;Fifth,increase investment and develop government purchase services in the field of third-party evaluation.In the end,the author sincerely hopes that the views and suggestions proposed in the paper can be used as a reference for the current pilot work on the construction of a thirdparty evaluation mechanism of public legal service in some areas of China.In this way,the research can be considered as a valuable one.
