During the Ming and Qing dynasties,the commodity economy in Shanxi region achieved sufficient development,and cross regional trade also increased day by day.Transactions between merchants became more frequent,resulting in a large number of trademark disputes.As a representative group of merchants during the Ming and Qing dynasties,Jin merchants have developed mature trademark protection habits.Studying this habit has strong theoretical research value and practical reference significance.Unfortunately,currently,domestic and foreign scholars mainly study Jin merchants from political science,economics,history,cultural studies,sociology,and other aspects,and research on the trademark protection habits of Jin merchants is very limited.During the Ming and Qing dynasties,Jin merchants established a strong commercial civilization,and their trademarks became increasingly prosperous,resulting in various forms of trademarks,including seals,plaques,trade names,packaging,ticket numbers,posters,word-of-mouth trademarks,etc.With the frequent use of trademarks,trademark disputes and infringement cases are gradually increasing.In order to promote the healthy development of Shanxi merchants,there is an urgent need for a standardized system to protect them.However,influenced by legislative ideas such as valuing agriculture over commerce and valuing punishment over the people,there was a lack of official legislation and systems related to trademark protection during the Ming and Qing dynasties,which created space for the emergence of trademark protection habits among Jin merchants.The trademark protection habits of Shanxi merchants in the Ming and Qing dynasties were mainly manifested in the form of individual protection of merchants,guild rules,code rules,etc.These ways played an important role in regulating unfair competition and trademark infringement from form to content.At the same time,the trademark protection habits of Jin merchants during the Ming and Qing dynasties also had strong protection mechanisms.Firstly,they resolved trademark infringement disputes through private mediation mechanisms,including internal family mediation and guild mediation.The second is to provide public protection for trademarks through official registration and litigation channels.The trademark protection habits of Jin merchants during the Ming and Qing dynasties were undoubtedly successful at that time.They not only ensured the healthy development of Jin merchants,regulated their trademark behavior,but also played a role in filling the gap in the official trademark protection system.Mediating trademark disputes through unofficial means also played a very important role in protecting Jin merchants’ trademarks from excessive administrative restrictions and interference at that time.Now we don’t need to mechanically copy the trademark protection habits of Shanxi merchants,but we can draw the essence of the past.Firstly,during the Ming and Qing dynasties,Jin merchants developed a certain awareness of trademark protection.In the process of modern trademark protection,it is necessary to strengthen the merchants’ trademark awareness and actively prevent trademark infringement.Secondly,the organization of the Jin Merchants Guild has played a huge role in the process of trademark protection for Jin merchants.Modern trademark protection should attach importance to the role of the guild,improve its self-discipline function,and strengthen its trademark autonomy.Finally,there are multiple ways for Jin merchants to choose between trademark protection and trademark dispute resolution.Modern trademark protection can enrich trademark protection channels and promote trademark protection and dispute resolution by establishing diversified trademark dispute resolution mechanisms.
