Research On Xi Jinping’s Rule Of Law Thought From The Perspective Of Marxist Philosophy

Since the 18 th CPC National Congress in 2012,Xi Jinping has put forward the "law-based governance" and incorporated the construction of the rule of law into the comprehensive strategic layout of the country,highlighting the importance of the rule of law in the governance of the country and gradually forming Xi Jinping Thought on the Rule of Law,which provides fundamental theoretical guidance for the construction of China under the rule of law.Xi Jinping’s thought on the rule of law has become a hot topic of concern and research in the academic community.Studying Xi Jinping’s Thought on the Rule of Law from a Marxian philosophical perspective will not only help deepen the theoretical study of Xi Jinping’s Thought on the Rule of Law and provide methodological guidance for the construction of China under the rule of law;it will also help clarify a series of major relationships in the construction of the rule of law in practice,enhance awareness of the rule of law,improve the ability of the rule of law,use the rule of law to safeguard and guarantee social justice,and continuously promote the process of building China under the rule of law.Based on 《Xi Jinping: The Governance of China》and other relevant documents and《the Study Outline of Xi Jinping’s Thought on the Rule of Law》,Xi Jinping’s thought on the rule of law has been theoretically and practically explored from the perspective of Marxist philosophy,using documentary research methods,the unification of logic and history,comparative analysis and other research methods,and on the basis of the relevant research results available in the academic community:Firstly,Xi Jinping’s thought on the rule of law is formed with the Marxist view of practice as the theoretical cornerstone,the practice of the rule of law in the new era is the practical basis for its formation,and the theoretical and practical achievements of the rule of law in China and abroad are the ideological sources for its formation.Secondly,Xi Jinping Thought on the Rule of Law inherits the Marxist theory of the essence of law and the existence of law,bases itself on the new changes in the main contradictions of Chinese society in the new era,combines the practice of the rule of law in China in the new era,and makes innovations to the Marxist view of the rule of law based on the theory of the essence of law and the existence of law,and summarises the main contents of the comprehensive rule of law as "eleven insistences " It emphasizes that the leadership of the Party is the soul of the socialist rule of law in China,and advances the Party’s knowledge of the socialist rule of law with Chinese characteristics to a new stage.Once again,the people’s position is the basic position of Xi Jinping’s thought on the rule of law,emphasising the need to give full play to the people’s enthusiasm in the construction of China under the rule of law,to uphold social justice with good laws and good governance,and to take the satisfaction of the general public as the criterion for judging the success of the construction of the rule of law.Fourthly,Xi Jinping’s thought on the rule of law is rich in materialistic dialectics,such as the method of analysing the basic contradictions in society,the systemic approach,and the method of thinking about the rule of law,viewing the construction of China under the rule of law as a complex organic whole,and taking a problem-oriented,integrated plan to comprehensively promote the construction of China under the rule of law.Finally,the value of studying Xi Jinping’s thought on the rule of law from a Marxist philosophical perspective is clarified.Theoretically,it helps deepen the theoretical understanding of Xi Jinping’s thought on the rule of law and provides theoretical guidance for the construction of China under the rule of law;practically,it helps adhere to the comprehensive rule of law and advance the process of building China under the rule of law.
