A Study On The Critical Logic Of The Introduction To Hegel’s Critique Of Legal Philosophy

Lenin once put forward the view that Marx had "two changes" in thought during the period of the German and French almanac,and the introduction to Hegel’s critique of legal philosophy was published in the German and French almanac,which also has important research value.However,in the interpretation of the introduction,there are some viewpoints such as defining the article as "mature" or "immature" period or "epistemological fracture".Based on this,through the study of Marx’s critical logic,this paper expounds Marx’s ideological and theoretical logic,critical purpose and method.In order to grasp the internal path of Marx’s ideological development in this period,to form a scientific theoretical understanding of Marx’s early thought,and to make a scientific judgment on the theoretical status of the introduction.With the help of historical materialism and logical analysis,through the study of classical texts,it can be found that the real purpose of Marx’s critique of Hegel’s philosophy of law is not only to solve the problems of material interests encountered before,but also to pay attention to how to solve the practical problems in Germany,and reflect on "human freedom" through this critique,which is also the core issue of Western ideology and culture since modern times.From the perspective of the evolution of criticism,Marx’s critical logic approach is to turn from religious criticism to realistic criticism,rise from the special criticism of German politics and reality to the general criticism of modern western culture,and finally return to the political criticism of reality and rise to the criticism of philosophy.In the process of criticism,Marx applied the methods of contradiction analysis,practical philosophy and class analysis to critically study the idealist dialectics and national economics in Hegel’s legal philosophy system,which reversed the "subject predicate" relationship.In the deconstruction of Hegel’s philosophy,we set up a path to study problems from the reality of people and civil society and look for a way out that can truly realize people’s liberation,which reflects the preliminary proposal of historical materialism in Marx’s philosophical thought,the preliminary development of political economy criticism and the preliminary formation of materialist dialectics in this period.The study of the critical logic of the Introduction and its theoretical value is not only the key to understand the development and transformation of Marx’s thought in this period,but also the key to look at the "two transformations" summed up by Lenin and reflect on the theoretical position of the Introduction in the development of Marx’s thought.In "introduction",Marx proposed from this side "across the world to the world",from "critique weapon to critical thought revolution",embodies the philosophy thought realize the transformation from abstract to reality critique,from theory to practice critique of change,is to realize the "two transformation" of "material basis" and the "theoretical kernel".Thus we can realize that Marx’s thought transformation is to construct his own rational thought development path on the basis of criticizing Hegel’s philosophy of law.In addition,the abundant critical spirit and relevant legal philosophy thoughts contained in the article are of great guiding significance to the cultivation of scientific critical thinking and the construction of a socialist legal society with Chinese characteristics in the new era.
